Welcome to the April 2024 edition of our regional cannabis news update. In this month’s edition, we’re covering the latest updates shaping the northeast cannabis landscape, from New York’s progress in adult-use licensing to efforts in New Jersey to legalize home cultivation. Read on for more detail about what’s happening in the cannabis industry across the region.

New York State Cannabis Control Board approves 101 new adult-use licenses 

On April 12, the New York State Cannabis Control Board (CCB) approved 101 new adult-use licenses, bringing the total number of licenses granted in 2024 to 403. 

The breakdown of the 101 licenses approved includes the following types:

  • Adult-Use Cultivator License: 25
  • Adult-Use Distributor License: 11
  • Adult-Use Microbusiness License: 22
  • Adult-Use Processor License: 8
  • Adult-Use Retail Dispensary License: 25
  • Provisional Adult-Use Retail Dispensary License: 10

“With the Cannabis Control Board’s issuance of 101 adult-use cannabis licenses, New York’s legal cannabis industry continues to make significant progress with over 400 licenses issued in 2024,” said Governor Hochul. “Strengthening New York’s equitable cannabis industry and ensuring the hard-working small business owners operating in the legal market have the licenses to open are the best ways to protect the integrity of sales in New York.”

The CCB also passed a resolution empowering the Office of Cannabis Management (OCM) to issue provisional adult-use licenses to streamline the licensing process and promote industry growth. This update will allow provisional licenses to be awarded outside regularly scheduled board meetings. 

New Jersey lawmakers and activists push for home grow legalization 

New Jersey cannabis advocates and lawmakers are applying pressure to legalize home-grown cultivation of cannabis as neighboring states continue to move forward with similar measures. 

Currently, only individuals holding cultivator licenses are permitted to grow cannabis under state law. Individuals, including medical cannabis patients, cannot grow their own plants for personal use in New Jersey. Growing your own cannabis remains a third-degree felony. By contrast, in New York, patients and their caregivers are allowed to grow a limited amount of plants.

Senate President Nicholas Scutari (D) has been a prominent figure in expressing reservations about a home-grow program, citing concerns that it could hinder the growth of the legal cannabis industry and inadvertently bolster the underground market. 

Critics, however, including Chris Goldstein from the National Organization for the Reform of Marijuana Laws (NORML), argue that such hesitancy is misplaced. This highlights the frustration among small business owners, consumers, and patients. Goldstein and other advocates have taken to protesting in front of the New Jersey State House in Trenton to challenge the state and Scutari’s stance. 

“The small business owners I talk to, the consumers, the patients, they say he’s off base,” said Goldstein. “And again, the delay has been really terrible for New Jersey.”

Study finds cannabis could bring $41 million in tax revenue to Pennsylvania in its first year

A study conducted by Pennsylvania’s Independent Fiscal Office (IFO) found the state could eventually generate $271 million in annual tax revenue through legalization of cannabis as proposed by Gov. Josh Shapiro. The estimate takes into account a 20% excise tax on wholesale cannabis alongside revenue from state sales tax. In the inaugural year of legalization, Pennsylvania could expect to see approximately $41 million in tax revenue, the report reads.

The IFO analysis highlights the fact that neighboring states have already enacted legalization measures, potentially limiting Pennsylvania’s revenue as customers seek products across state lines. 

“Currently, all border states except West Virginia have legalized and imposed tax on adult recreational use cannabis. These taxes were enacted recently in Ohio (2023), Maryland (2023), New York (2021), and New Jersey (2020),” reads the report. “Because nearly all border states already tax recreational cannabis, the estimate is not increased for cross border sales that may have occurred in other states that were first to tax recreational marijuana in a region.”

Still, the report suggests that legalization could be a boon for Pennsylvania’s public coffers, adding momentum to the growing cannabis legalization movement in the state’s capital.

As spring blooms and 4/20 celebrations have come to a close, the national cannabis industry is on a high right now (pardon the pun). It’s already been a busy season in cannabis, including record-breaking sales and significant legislative developments. Join us as we recap recent headlines and explore what’s going on in the cannabis industry across the nation.

Congressional lawmakers continue demands for rescheduling

A bipartisan group of 21 congressional lawmakers is applying pressure to the Drug Enforcement Administration (DEA), urging swift action to reclassify cannabis from its restrictive Schedule 1 status. 

Led by Sens. Elizabeth Warren (D-MA) and John Fetterman (D-PA), along with Reps. Earl Blumenauer (D-OR) and Barbara Lee (D-CA), the coalition penned a letter to DEA Administrator Anne Milgram and Attorney General Merrick Garland highlighting the urgent need for rescheduling. Noting the eight-month lapse since the U.S. Department of Health and Human Services (HHS) recommended this shift, lawmakers emphasized the imperative need for the DEA to act promptly. 

“Though marijuana is widely used and… associated with fewer adverse outcomes than alcohol, it remains in the most restrictive schedule,” the lawmakers wrote in the letter. “This placement produces a cascade of severe penalties for marijuana users and businesses, including for criminal records, immigration statuses, employment, taxation, health care, public housing, social services, and more.”

Cannabis tech firms report strong cannabis sales on 4/20 

Jane Technologies, a cannabis tech firm specializing in e-commerce and point-of-sail solutions, released a report highlighting strong cannabis sales during the 4/20 holiday. Jane’s network spans more than 2,500 dispensaries and brands across 39 U.S. states and Canada, offering a substantial perspective of activity within the industry on its flagship holiday.

The total number of transactions at Jane-powered locations reached 245,926 on 4/20, marking a notable 1.67% increase from the previous year’s figures. Total transactions for the entire holiday weekend surpassed 500,000, according to a statement released by the company. Jane Technologies also reported record-breaking sales figures in many states, most notably in Illinois, where sales at retailers in the Jane Technologies network soared to almost $4.5 million. 

“We saw record-breaking sales across the country this 4/20,” Soc Rosenfeld, Jane Technologies CEO and co-founder, said in a statement. “At Jane, it was an extremely successful day with well over half a million transactions completed on the platform this holiday weekend.”

According to the report, top-performing brands included Rythm, &Shine, STIIIZY, Savvy, and Float. Flower emerged as the most popular product type, followed closely by vapes and edibles. 

Cannabis POS platform Treez, which operates in 11 states and serves over 600 dispensaries, reported similarly booming sales data. According to data from Treez, there was a 120% increase in customers, products sold, and gross sales compared to 4/20 in 2023. 

However, according to Treez, the biggest spike in sales came the day prior as consumers sought to stock up ahead of the holiday. On April 19, Treez reported a 200% increase over last year’s numbers. That suggests that the day before 4/20 provides an even bigger bump for retailers, as many consumers prefer to refresh their stash ahead of the holiday festivities. 

Schumer pushes to pass cannabis banking bills in ‘bipartisan way’ 

Senate Majority Leader Chuck Schumer (D-NY) is once again championing a bipartisan effort to advance the Secure and Fair Enforcement Regulation (SAFER) Banking Act among a list of legislative priorities for the year. Speaking at a press briefing on April 23, Schumer emphasized the need for bipartisan cooperation in addressing various legislative matters. In addition to the SAFER Banking Act, he underscored the importance of addressing issues like insulin pricing, online child safety, and railway safety. 

“We’ve got a lot to do,” Schumer said. “And if we can work in a bipartisan way, we will.”

Schumer has repeatedly pushed to move the SAFER Banking Act, which previously cleared the Senate Banking Committee last September before dying without a floor vote. However, the Senate recently approved long-awaited and contentious appropriations legislation that may have cleared the way to focus on new legislative items like cannabis reform.

Licensing News

On March 11 the Office of cannabis Management issued the Adult-Use December Queues on the OCM website. There were five queues made from a random sequence process for each type of license for applications submitted within the application window that ended December 18, 2023. The queues represent a review order for the OCM itself and do not represent the order in which licenses will be issued. Furthermore, inclusion in a queue does not guarantee getting a license. The five queues were audited by a third party. There are queues for:

  • Cultivator
  • Processor
  • Distributor
  • Retail Dispensary
  • Microbusiness Applicants

Also noteworthy in March, the OCM issued a listing of what they call a Proximity Protected Locations Map (PPLM). The intention with this is to provide transparency on locations of licensed cannabis dispensaries, as well as those proposed locations on applications that are still under review. Proposed locations have what is called proximity protection since the OCM reviewed the locations and have deemed them compliant regarding distancing and proximity requirements until the final determination on a application is made. The PPLM is meant to be a helpful aid to identify potential locations for a cannabis dispensary.

In our February Newsletter, we highlighted the positive reports that the New Jersey Cannabis Regulatory Commission gave about the number of opened dispensaries and the revenue to date for medical and recreational sales. The news just keeps getting better.

The combined revenue for medical cannabis sales and recreational sales since recreational went into effect April 2022 is already over $1.3B to date. The expectation is that in 2024, medical and recreational sales could see over $1B in combined sales.

Governor Glenn Youngkin Does Not Want to Legalize Adult-Use Cannabis

The suspense is over. Governor Glenn Youngkin vetoed the piece of legislation that was passed in late February by both the Virginia state General Assembly and the state Senate to launch a Virginia Adult-Use cannabis industry. The Adult-Use Cannabis Sales bill would have taken effect in May 2025 and sought to build a legalized commercial adult-use market in Virginia. Youngkin made some strong statements about the legislation that he vetoed.

In addition, Youngkin’s veto power did not stop at just one cannabis bill. He also vetoed a bill that would have allowed individuals who were incarcerated for certain marijuana offenses to receive automatic re-sentencing hearings and have their punishments adjusted. No dice.

Lastly, it seems that Youngkin’s views are simply not in step with the majority of Virginians and their views on cannabis and legalization as suggested by a poll released earlier this month by the Institute for Policy and Opinion Research at Roanoke College.

Hawaii has advanced several cannabis legislation bills that seek to expunge tens of thousands of cannabis convictions. The proposals spelled out some legislation to create an adult-use market in Hawaii.

Descheduling vs. Rescheduling

The industry has been abuzz for weeks with the prospect of rescheduling and with even louder calls for descheduling. Several important things that deserve highlighting include:

  • President Biden’s comments made during his State of the Union Address in February where he asserted his support for cannabis reform.

     

  • Vice President Kamala Harris’s meeting this month in March, where she met with several industry influencers, stakeholders, and some who received pardons for cannabis offenses. Included in the notable attendees were hip hop artist and rapper Fat Joe, and Chris Goldstein, Regional Coordinator for NORML. Harris made comments that were bold and welcomed by those in the room and gives a positive prospect for real action by the Federal Government.

March brought some dynamic shifts in the political culture surrounding cannabis. Vice President Kamala Harris led discussions on legalization and pardons, while Senate Democrats and House Republicans continued to push for cannabis banking reform. Could these developments be signs of growing momentum towards a shift in federal cannabis policy? Explore the impact of these updates on the cannabis industry nationwide.

VP Kamala Harris holds meeting on cannabis legalization and pardons 

Vice President Kamala Harris held a closed-door White House roundtable discussion on cannabis policy on March 15, 2024. Among the attendees were figures such as Cynthia Roseberry, Director of Policy and Government Affairs, Justice  at the ACLU; rapper Fat Joe; Chris Goldstein, Regional NORML organizer; Kentucky Governor Andy Beshear; and White House Director of Public Engagement Steven Benjamin. 

VP Harris used the discussion as an opportunity to emphasize the injustice of cannabis-related incarcerations, stating that “nobody should have to go to jail for smoking weed.” According to Goldstein, Harris also shared meaningful dialogue with Fat Joe regarding the importance of legalization and expressed support for ending the federal prohibition.

“The moment where she raised her hands in the air and said, “We need to legalize marijuana” — saying those words out loud, saying it in the Roosevelt Room, it did feel very meaningful, and it wasn’t lost on anyone there what was going on in that moment,” Goldstein told Marijuana Moment.

The Department of Health and Human Services (HHS) conducted a scheduling review in August 2023 and concluded to the DEA that cannabis be reclassified to a Schedule III drug. While there is no timeline for when the DEA’s review could take place, conversations like these represent strides forward. “This is the first time the White House has asked for a scheduling review in the right manner, so we don’t have a context for how long they might be able to run out the clock,” Goldstein added. 

Senate Democrats and House Republicans continue to push for cannabis banking bill 

As Congress nears the passage of a package of spending bills for the 2024 Fiscal Year, bipartisan attention has again turned to advancing the Secure and Fair Enforcement Regulation (SAFER) Banking Act. Senate Banking Committee Chairman Sherrod Brown (D-OH) expressed optimism about the bill’s prospects in a recent interview, sharing hope that the measure will immediately pass on the floor this year. 

“We’ve got a House that’s still not moving on stuff that matters to Republicans,” he said, referencing party divisions in the chamber. “The truth is that’s really pushed us back on what we can do in the Senate with floor time.”

In parallel, House Majority Whip Tom Emmer (R-MN) reiterated his support of the SAFER Banking Act during an American Bankers Association (ABA) summit. Emmer emphasized the need for federal action on banking reform, citing the sluggish pace of incremental reform despite his personal stance on the issue.

“For whatever reason, the federal government has been slow to get that done,” he stated. “Like it or not, if your state has enacted laws creating this as a legal entity that is legitimate, our bankers should be allowed to bank,” he added. “It’s not whether you are a marijuana lover or hater, it’s more: This is a legitimate business that has been approved by the representative government of that state.”

IRS clarifies cannabis cash reporting regulations 

The Internal Revenue Service (IRS) issued a memo clarifying the rules for reporting large cash payments between cannabis businesses. In response to a request for guidance on Form 8300, which mandates reporting for cash payments exceeding $10,000, the IRS emphasized that such transactions should not automatically be flagged as “suspicious” solely due to the federal prohibition of cannabis. 

An example of the other language in the memo includes:

Question 3: “Is it reasonable for a legalized substance business to check the suspicious activity box simply because of the type of product they deal with?”

Answer 3: No. When marking the suspicious activity box is purely done defensively, much like a Money Service Business filing defensive Significant Activity Reports, this is an abuse of the use of that box. If they are solely marking the box because of the industry and for no other reason, this is not an appropriate use of the box. If a business is checking the box in these circumstances, the agent should inform them that continuing to check the box could result in penalties for inaccurate forms. Of course, this depends on the facts and circumstances in each case.”

“We are working on additional guidance on questions related to cash couriers/armored cars who transport cash between growers/manufacturers and dispensaries/sellers,” reads the memo.

Hochul orders ‘top-down’ review of New York cannabis licensing process

New York Governor Kathy Hochul (D-NY) has officially ordered a comprehensive “top-down” review of the Office of Cannabis Management (OCM) licensing process. Hochul announced the review while recognizing the shortcomings and challenges the existing framework posed following cannabis legalization. The governor enlisted the expertise of Jeanette Moy, the commissioner for the Office of General Services, to overhaul the process and streamline operations. 

According to a press release from the governor’s office, the internal audit will last at least 30 days and include:

  • Top-down review of organizational structure, processes, and systems with a focus on improving OCM license processing times and application-to-opening timeframes for new cannabis retailers and businesses.

  • Development of key performance metrics and an executive-level licensing dashboard to provide the Executive Chamber with a timely, accurate, and comprehensive picture of licensing activity for legal retailers.

  • Identification and implementation of changes to policy, procedure, and regulation (within the bounds of the MRTA) to streamline the licensing process and simplify application and review for prospective licensees.

  • Development of three-month and six-month action plans with organizational change initiatives, milestones, and actions to continue improving agency functions while developing a world-class licensing and regulatory agency for the state’s cannabis industry.

After the 30-day assessment, Moy and her team will consider a prolonged examination of the OCM and its practices.

New York hemp companies sue to overturn new state rules

The New York State Cannabis Control Board (CCB) passed stringent regulations in November 2023, which imposed a mandatory 15-to-1 ratio of CBD to THC in hemp-based products and limited potency to  mg THC per serving or 5mg THC per package.

These rules made an estimated 75% of already available hemp goods suddenly illegal and sparked outrage among state-licensed companies. On March 1, a lawsuit was filed in federal court as a result. 

The lawsuit, brought by 10 hemp companies, alleges the enforcement of these regulations, coupled with aggressive raids targeting the illicit market, has caused significant financial losses for hemp businesses and infringed upon their constitutional rights. According to the lawsuit, the change “drastically limits the products available for market” and will push New York consumers “into the illicit market and underground market.” 

“We will not standby and allow the State to violate Plaintiffs’ constitutional rights, engage in warrantless searches and seizures, and maliciously disrupt their businesses in a misguided effort to shut down unlicensed cannabis stores, which have nothing to do with hemp businesses operating in full compliance with both state and federal law,” Joshua Bauchner, chair of the Cannabis, Hemp and Psychedelics Practice Group at New Jersey-based law firm Mandelbaum Barrett said.

New Jersey surpasses 100 cannabis stores, sales top $2 billion in last six years

New Jersey has achieved a notable milestone in its cannabis industry, officially surpassing 100 cannabis stores. The New Jersey Cannabis Regulatory Commission’s (NJCRC) website confirms the presence of 102 medical and adult-use retail locations statewide. In addition, the group shared that the state’s total cannabis sales over the last six years have exceeded $2 billion. 

“These are early signs of the potential of this market. Sales have grown steadily since Governor Murphy began the work to reform New Jersey’s cannabis market,” said NJCRC Executive Director Jeff Brown in a statement.

Pennsylvania joint committee takes up cannabis legalization as governor renews push for reform

Pennsylvania lawmakers are once again pushing for cannabis legalization, with a recent focus on Prohibition’s criminal justice implications and the potential benefits of reform. Members of the Subcommittee on Health Care and the Judiciary Subcommittee on Crime and Correction convened for a hearing explicitly addressing these issues. 

During the hearing, Representative Dan Frankel, chair of the Health Committee and a previous sponsor of cannabis legalization legislation, expressed confidence in the state’s readiness to advance cannabis reform. “I think we are really well-positioned to move forward with legislation,” said Frankel. 

Rep. Rick Krajewski (D) stressed criminal justice and record expungement as one area lawmakers “really need to get right, and get right on the first time, given what we know about the criminalization of cannabis and the ways it has impacted Black and brown communities, working class communities and the ways in which that record still carries a burden.”

Responsible PA has also formed a coalition focused on calling for the legalization of adult-use cannabis, saying they intend to inform lawmakers as they continue to explore the issue. The coalition brings together patient advocates, doctors, scientists, researchers, laboratories, economic development groups, members of law enforcement, local elected officials, labor, and civil and social equity community organizations from across the state. 

“Pennsylvania has the opportunity to build from the success of its medical cannabis program while ensuring full market access for regulated products,” said Warren County District Attorney Rob Greene (R). “Just as we do with medical cannabis, we can properly regulate adult-use marijuana with stringent health and safety standards backed by regulatory oversight.”

Judge Rules for NYS in Lawsuit

NYS has gotten over another hurdle in court. On February 2, Judge Nardacci ruled against plaintiffs citing unfair issuance of licenses that was based on the social equity criterion laid out in the Marijuana Regulation and Taxation Act passed on March 31, 2021. Previous lawsuits claiming similar complaints were settled. The result of the latest ruling by Judge Narducci is a good sign that NYS is continuing to move the industry forward.

Plan to Shut Down Illicit Cannabis Operations

In our January 2024 Newsletter, we noted that Governor Kathy Hochul is committed to shutting down illicit cannabis shops across New York State. The movement to get this done has taken off in recent weeks with several local lawmakers at the NY Assembly and Senate levels supporting legislation and funding targeted at the closing of illegal shops and providing more authority to NYC Mayor Adams and the NYPD to get the job done.

Queens Assemblywoman Jenifer Rajkumar has aggressively been pushing her proposal to shutter illegal cannabis operations across the city, while Queens Senate member Leroy Comrie has pushed to get the law into the budget. It is called the Smoke Out Law.

Some good news for NYS revenues: NYS’s total adult-use cannabis sales are climbing toward $200MM since MRTA was passed. As of this month, total adult-use sales reached $183MM, as reported by the Office of Cannabis Management and Governor Hochul.

Also this month, the NYS Office of Cannabis Management (OCM):

  • Issued over 100 licenses in mid-February including 38 new Retail Dispensary Licenses, and 26 Micro-business Licenses.
  • Approved Home Grow Cultivation Regulations
  • Opened a new application window for more type 3 processor applications and to allow conditional cultivators and processors to continue transition to non-conditional licenses

Governor Josh Shapiro Wants to Legalize Adult-Use Cannabis

Will Pennsylvania legalize adult-use cannabis anytime soon? Governor Ron Shapiro is supporting it and presented some key points during his February budget presentation as part of his efforts to legalize adult-use in PA. In his presentation he cited estimated cannabis revenues, social equity, and expungement of minor cannabis offenses and arrests. Not all groups in PA are supportive of the Governor’s efforts.

A poll found that the call to de-schedule cannabis is overwhelmingly supported by both Democrat and Republican voters. The results of a poll featured in NORML.org, compiled by The Tarrance Group, showed that well over 50% of respondents want to see full legalization in all 50 states.

On February 15, President Volodymyr Zelensky signed the December 21, 2023 bill that was approved by Ukraine’s Parliament. This new law will provide access for medical patients seeking treatment for a variety of conditions including PTSD. The war has created the need for medical cannabis to help treat the traumas of the war suffered by soldiers and citizens. Patients will need a prescription from a doctor to get the medical cannabis and to legally buy it. Recreational cannabis remains illegal. The new law takes effect in July 2024.

Cannabis Revenue Report

The Office of Cannabis Management has issued their 2023 Annual Report. In the report, retail cannabis sales revenue for store fronts is detailed as of December 9, 2023. The document is well-organized, convenient to read through and is available for download. In addition, the report details facts, stats and information about licenses issued in 2023, legal dispensaries, the social equity program and many other topics.

Eradicating Illicit Cannabis Operations

On January 9, 2024 Governor Kathy Hochull outlined in her State of the State Address that NYS is firmly committed to supporting legal cannabis shops and shutting down illegal cannabis operations across the state. Hochul outlined the goal:

“As we continue to build and expand the most equitable legal cannabis market in the nation, we cannot let the brazen, illegal operators undermine public health and threaten our neighborhoods,” Governor Hochul said. “Last year, we passed new laws to padlock and shut down illegal operators, but we know there’s more to be done and we need more tools to do it. We’re going to continue working with local leaders, including in New York City, to shut down illegal cannabis stores once and for all.”

Hochul proposed new legislation that:

  • Cracks down on ilicit cannabis store fronts and closes them down
  • Expands the powers of the OCM to combat illicit cannabis operations including authorizing local governments to padlock them

Cannabis Potency Tax

Also on Hochul’s cannabis to-do list was a proposal to reform the cannabis potency tax to be reduced to a flat 9% excise tax. The potency tax is an onerous tax that makes legal cannabis very expensive and deters buyers from going into legal dispensaries to buy products. This proposal tries to address that.

NJCRC Says Consumption Lounges are Coming Soon

More good news from the New Jersey Cannabis Regulatory Commission (NJCRC) regarding consumption lounges. On January 18, 2024, the NJCRC issued the guidelines for consumption lounges and how they can be part of an existing dispensary. What is appealing about the NJCRC guidelines is that the fees to add a consumption lounge to one’s dispensary appear reasonable.

First Year Adult Use Sales Revenue

January 10, 2024 marked the first full year since adult-use sales began in Connecticut yielding a combined sales revenue of $274 million for adult-use and medical cannabis.

“One year ago, the state of Connecticut opened an entirely new market, creating jobs, opportunity, and a safe, regulated way for adults to purchase cannabis,” said DCP Commissioner Bryan T. Cafferelli. “This was no small task, and the team at DCP launched this new market in a thoughtful, measured way. Since then, many new businesses have opened and more are on the way. We are proud of the work carried out by our agency over the past year, and we are looking forward to continued growth, fair regulation, collaboration with our sister agencies, and thoughtful problem solving as new challenges present themselves in the years to come.”

Rescheduling

The issue of rescheduling cannabis from a Schedule I to a Schedule III classification has heated up this month since the department of Health and Human Services (HHS) released unredacted documents which revealed that the HHS has a clear position recommending that the Drug Enforcement Administration (DEA) reschedule it to Schedule III. In addition, the unredacted documents discusses quite explicitly that cannabis has medicinal use. The unredacted documents provide an inside look at what the HHS was really thinking to reach the recommendation they made to the DEA.

Twelve Attorneys General Ink Letter to DEA

Also this month, Colorado Attorney General Phil Weiser led eleven other Attorneys General to sign a letter calling on the DEA to reschedule cannabis and stating that they are supportive of the HHS’ recommendations to reschedule it from Schedule I to Schedule III. The states joining Colorado were New York, New Jersey, Connecticut, Delaware, Massachusetts, Pennsylvania, Oregon, Nevada, Rhode Island, Illinois and Maryland.

The Office of Cannabis Management and the Cannabis Control Board regulators voted on November 27 to settle the two lawsuits that held up hundreds of Cannabis Adult Use Retail Dispensary (CAURD) card holders from actually opening up their dispensaries. The temporary injunction put forth was lifted for the two lawsuits and gave the green light to the 436 licensees to finally move forward. At least 23 of those CAURD holders were ready months ago before the injunction and can now proceed.

Governor Kathy Hochul expressed that NYS is committed to supporting legal cannabis shops and shutting down illegal cannabis operations.

First Dispensary Opened in Mt. Vernon, Westchester

NJCRC Announces Reduced Fees

The New Jersey Cannabis Regulatory Commission (NJCRC) announced some good news for medical cannabis patients and their caregivers. Instead of the $50 per year for most registrants and the $20 for seniors to register in the Medicinal Cannabis Program (MCP), it is now $10 for everyone as of December 7, 2023. Plus, patients and caregivers will be able to receive free Digital ID cards or pay $10 for a physical card.

NJ Governor Jim Murphy and Attorney General Matthew Platkin announced anti-violence measures that will be funded with $15MM, of which $5MM is coming from marijuana revenue. Germany’s Cannabis Legalization Delayed

Germany was set to legalize cannabis starting as soon as the new year but has been delayed until well into 2024 according to the German Health Minister, Karl Lauterbach. Germany appears to have a well-thought out and well debated cannabis legalization plan that includes cannabis social clubs and modifications to home grow regulations.

Ukraine’s Cannabis Bill Expected to Pass Early 2024

In our July Newsletter we highlighted that Ukraine’s President Volodymyr Zelensky is in favor of legalizing medical marijuana, and that the country’s legislature was poised to do so until an opposition faction blocked its passage. It is expected that this opposition will be overcome and the bill will pass in January 2024, and the law will become effective six months later.

This month our discussion focuses on the medical marijuana market and medical marijuana patients and how adult-use legalization is affecting medical use.

Ken Weinberg, MD

Ken is a practicing physician with decades of experience in emergency medicine and urgent care. He is a published author of medical articles across many disciplines and is currently working on a book about his experiences in front-line medicine, including the 1500 or so patients he has seen as a registered Cannabis Practitioner since 2016. He is the Founder of Cannabis Doctors of New York.

Among his many medical commitments, he serves as the Attending Cannabis Consultant at Inspir – a private nursing home in New York City. At that facility he provides medical expertise and guidance for elders who are interested in using cannabis as part of their medical care. Ken works with several dispensaries in the New York area as well.

Ken – I have mixed feelings. The fact that many of our medical patients are opting to go to the rec market has caused a precipitous drop in medical patients. And while I am sure that some of the people who have made the switch will do okay, one of the reasons I like the NY medical cannabis space is that there are pharmacists involved. Cannabis medicine is medicine, with exact dosing, possible drug interactions and effects that budtenders should not be opining on.

*Editor’s Note: Medical dispensaries (ROs) must have a registered pharmacist to dispense the medical marijuana to patients. There is also a requirement that any RO who is approved for participation in the adult-use market must have a separation of the medical marijuana and the adult-use retail sections.

CWCBExpo – Describe your recent presentation to a Northwell Resident group regarding educating them on cannabis as a medical treatment. Were there any particular conditions, diseases or symptoms that you focused on in the presentation? What was the reaction of the medical residents who attended the presentation – was it well received?

Ken – For the last three years, I’ve been giving this lecture to the Family Practice residents. I talked about the Endocannabinoid System and similarities of the plant cannabinoids to the endogenous (produced inside the body) cannabinoids.

I spoke about how well my patients with autoimmune diseases (like Inflammatory Bowel Disease) do and about how I am seeing how very beneficial cannabis can be for patients with dementia. This was the best received talk I’ve given and I suspect I left them (and an initially skeptical Attending Physician) wanting more.

CWCBExpo – What do you think about Psychedelics as treatment for many medical conditions? Where do you see this going?

Ken – I think this is a huge, burgeoning area of medicine with great potential for benefits. Unfortunately, as with so much else in this country, the fact that they remain Schedule 1 narcotics leads to a hodgepodge of regulations and research in various states, and the federal government unable to provide some uniformity of guidance.

CWCBExpoWhat about micro dosing and the use of psychedelics as a medicine for treatment?

Ken – Micro dosing can be a good way to start, especially for “cannabis-naive” patients and the elderly, who may be very sensitive to the effects. I’m not involved with psychedelics but they seem to be very promising for a variety of conditions.

CWCBExpo What excites you most about practicing medicine and devoting your life to it? And furthermore, what can explain the motivation for you to include cannabis as a medical treatment?

Ken – I am a third-generation MD, and one of three brothers. One brother was a Family Practice and Naturopathic physician, the other an Oriental Medicine and acupuncturist so it feels like it’s in the blood. In fact, my niece is an OB-GYN doc, making her the fourth generation of Drs. Weinberg.

I think that medicine is a field where you can continue to grow, enrich your understanding, and be stimulated intellectually as well as be emotionally gratified even as you advance in age. I love my involvement in cannabis medicine because it provokes me all the time, and challenges me to understand how we interact with the plant, and how it may well be involved (in the best way) with the placebo effect. Lastly, as you alluded to, my love and long involvement with the interface of literature and medicine has caused me to write stories of my patient encounters for many years and has now led to my writing a book incorporating those stories along with the many influences on my life as a political activist doctor and writer.

The submission deadline is December 18, 2023. As we noted in our previous newsletters, there are five types of licenses:

New Dispensary on Long Island

Congratulations to Little Beach Harvest Dispensary that opened its doors in South Hampton, NY. The Little Beach Harvest Dispensary is owned and operated by the Shinnecock Indian Nation which is a federally recognized tribe living on their traditional lands in Long Island. This opening is a culmination of many years of effort by the Shinnecock Nation. The dispensary will offer adult-use and medical cannabis products to its customers as well as education and community involvement.

Governor Hochul Signs Additional Cannabis Tax Relief

Governor Hochul signed legislation, Senate Bill S7508 last week that allows New York City cannabis business owners and operators to deduct certain business expenses giving NYC cannabis businesses tax relief from the restrictive 280E Tax Code regulation. The newly signed legislation amended the NYC administrative tax code and now permits certain tax deductions related to the sale, production, or distribution of cannabis products.

NYS Regulators and Licensing Lawsuit

Some hopeful news. Several news outlets reported last week that the lawsuit from a group of disabled military veterans against NYS cannabis regulators, i.e., Office of Cannabis Management and the Cannabis Control Board, may be nearing some sort of an agreement that is awaiting finalization and approval by the courts. Once it is approved, it could lift the temporary injunction and allow hundreds of Cannabis Adult Retail Dispensaries (CAURD) licensees to open their doors.

REMINDER: NJ Cannabis Regulatory Commission (NJCRC) Comment Period Open Through December 15

A Public Comment period opened on October 16, 2023. The NJCRC is seeking feedback and commentary on their proposed regulations regarding the expansion of cannabis edibles in the New Jersey cannabis market. The comment period ends on December 15, 2023.

You can submit your comments in writing to the NJCRC or attend their next public meeting.

Update on Adult-Use Ballot Measure

On November 8, 2023, the Florida Supreme Court heard arguments regarding an Adult Use Ballot Measure. The oral arguments were heard from both sides, with each getting 20 minutes to present their cases regarding whether or not to add a ballot measure to the General Election on November 5, 2024.

As we asserted in our October Newsletter, the state’s Governor, Ron DeSantis, does not support the measure and neither does the Attorney General, Ashley Moody.

The Florida Supreme Court has until April 1, 2024 to decide on the case. The session where the arguments were heard “for” and “against” the Adult-Use Ballot Measure measure can be viewed on this YouTube video link. It really is a very interesting watch.

Ohio Approves Adult-Use

The results are in: Ohioans said “yesian” and voted to legalize Adult-Use Marijuana!

Ohio became the 24th state to legalize and regulate possession, home cultivation, retail sale of cannabis for those 21 years and older. Ohio is expected to bring in hundreds of millions of dollars in tax revenue if they do vote to legalize, according to an economic impact study done by Ohio State University.

Looming on the heels of Ohio voters making their decision at the ballot box, Governor Mike DeWine wants to tweak the laws.

Japan Allows Cannabis Derived Medical Products

Japan’s Lower House passed a bill last week that allows medical products derived from cannabis, while reinforcing other marijuana products that are banned. The bill also seeks to revise other laws related to cannabis. A known product, Epidiolex, approved for use in the United States and in Europe to treat epilepsy, is under a clinical trial in Japan. This bill may pave the way for its approved use in Japan.

Portugal is breaking records regarding how much medical cannabis it exports to other European countries. This year, it is expected to surpass the 2022 levels of exports which reached 9,271 kg. Portugal’s international medical cannabis trade has many benefits that positively impact its economy.

NYS licensing applications process opened and deadline extended

On October 4, the NYS Office of Cannabis Management (NYSOCM) opened the application process for five types of licenses. The submission deadline is December 18, 2023. The five types of licenses are:

  • Adult-Use Cultivator
  • Adult-Use Processor
  • Adult-Use Distributor
  • Adult-Use Retail Dispensary
  • Microbusiness

Five additional NY dispensaries opening up

Five more dispensaries are opening in New York City and in New York State after a judge ruled that these five can get an exemption from a court ruling that temporarily halted the well over 400 licensed CAURD holders from actually opening. There are now 27 adult use dispensaries open in New York State.

On October 5, 2023, the New Jersey Economic Development Authority announced that they awarded $12MM to 48 grant recipients.

Shuttered hemp businesses can reopen

In our last Newsletter we highlighted that Maryland had logged millions in cannabis sales since going Adult Rec on July 1. Now the previously shuttered businesses that sold hemp-derived products can reopen due to a recent ruling in October on a case filed by the Maryland Hemp Coalition and other businesses. The lawsuit  has yet to be resolved.

Keep on truckin’ – truck drivers and cannabis

The latest survey shows support among US truck drivers and their carriers regarding Federal testing rules for marijuana. The survey showed that over 60%  support testing for impairment rather than testing for use. Federal laws dictate that truck drivers are subject to testing before and during employment. With the current testing methods, a urine sample will show marijuana usage for up to a month. Tests reflect use, but not actual impairment. These testing practices have created a shortage of truck drivers with the ripple effect of supply chains being segmented and broken due fewer available drivers.

Switzerland

The first ever legal cannabis dispensaries in Europe will be opened in a major cannabis consumption pilot study between Sanity Group and the Swiss Institute for Addiction and Health Research. There will be two stores: the first will be located in Allschwil, Switzerland and the second in Liestal, Switzerland. The pilot study seeks to gather data about cannabis usage and health, among other things.
