PA Mulls Adult-Use as NY Expands Licenses

June 2024 was a dynamic month for cannabis news across the Northeast. From big strides toward potential adult use legalization in Pennsylvania to a key expansion of New York’s adult use market, this month’s update underscores the transformative potential of legalization not only economically, but also in fostering safety, equity and innovation. We’re also looking back at another great year for CWCBExpo and thanking everyone who joined us earlier this month. Let’s dive in!

 

CWCBExpo 2024 was a resounding success 

CWCBExpo kicked off with a bang on June 4, featuring pre-show events and workshops on topics like dispensaries, cultivation, and more. The expo floor, open from 10 am to 5 pm over two days, showcased a range of exhibits presenting the industry’s latest products, services, and technologies. The programming offered informative sessions on everything from regulatory updates to investment strategies and market trends. 

 

Notable highlights included Glenna’s Cannabis Creations, Let Mom Sleep, and HappySap CBD-infused Vermont maple syrup. Dispensaries like The Other Side Cannabis from Jersey City represented the local area, while companies like GrowPros Solutions and TrufflyMade showed off their products and services. 

 

This year’s expo guest of honor was Josh Kesselman, founder and CEO of HBI International, known for the popular RAW Rolling Papers. 

 

“The CWCBExpo was RAWesome! I was honored to give the keynote in my birthplace of New York City, which I consider the birthplace of RAW. I believe that New York is the epicenter of cannabis,” Kesselman shared with Cannabis Now. “Which is why it was so important to me that I speak with our entrepreneurial market makers and do my best to help guide them through this transitional period, towards a New York cannabis market that provides opportunities to all of us. We all get higher together, especially when you have a New York State of mind!”

 

PA lawmakers preparing recreational cannabis bill 

In Harrisburg, PA, lawmakers are gearing up to introduce a new bill aimed at legalizing cannabis for adult use in Pennsylvania. The proposed legislation seeks to eliminate the illicit market, foster the growth of small businesses, and provide avenues for expunging certain cannabis-related convictions. 

 

Additionally, it: 

 

  • Establishes robust guidelines for the labeling, packaging, and advertising of products to ensure that products are not marketed to children and adolescents;
  • Implements a “clean slate” policy and criminal justice reforms for residents with cannabis-related convictions;
  • Provides funding and support for law enforcement to enforce cannabis regulations;
  • Provides funding for local municipalities with cannabis businesses;
  • Leverages our agricultural infrastructure and supports local farmers;
  • Generates new revenue for the state and creates jobs.

“I think it’s well past time for us to legalize cannabis,” said State Representative Emily Kinkead, a Democrat representing Allegheny County and prime sponsor of the soon-to-be-introduced bill. “The governor has estimated that it would bring about $500 million within five years,” she said. “I think that’s actually a pretty conservative estimate.”

 

Gov. Kathy Hochul announces more adult-use licenses 

New York Gov. Kathy Hochul (D) unveiled an expansion of New York’s adult-use cannabis sector at the latest Cannabis Control Board (CCB) meeting. The board approved 105 adult-use cannabis licenses across all factions of the industry, setting the stage for increased economic activity and innovation within the market. The breakdown of the 105 license types approved includes:

 

  • 25 Adult-Use Cultivator Licenses
  • 22 Adult-Use Distributor Licenses
  • 22 Adult-Use Microbusiness Licenses
  • 19 Adult-Use Processor Licenses
  • 17 Adult-Use Retail Dispensary Licenses 

The CCB also approved a resolution to adopt the following regulations for home-grow: 

 

  • Adults can grow up to six plants individually.
  • Maximum of 12 plants per household.
  • Registered medical cannabis patients can have a designated caregiver grow on their behalf, provided no one can exceed the maximum of 12 plants per household.

“New York is building a robust and equitable legal market that is driving significant economic growth within our communities,” Governor Hochul said in a statement. “The issuance of 105 additional adult-use licenses is just the next step in developing the nation-leading industry New Yorkers expect and deserve.”

 

PA could see up to $2.8 billion in adult-use sales in first year

According to Marijuana Moment, reports indicate that PA could experience a substantial economic benefit from legalizing adult-use cannabis, with projected sales ranging from $1.7 billion to $2.8 billion in the first year alone. Collaboratively produced by advocacy group Responsible PA and FTI Consulting, the analysis forecasts potential tax revenues of up to $720 million through a combination of retail sales and excise taxes. Moreover, legalization could generate between 26,250 and 44,500 new jobs, drawing comparisons from other states and insights from PA’s existing medical market. 

 

“Nearly two-thirds of the jobs supported by the adult-use market would be direct cannabis jobs, with the remaining third supported indirectly or through induced spending,” states the report.

While not the ideal designation the industry wants, May was all lit up with news of rescheduling cannabis from a Schedule I drug to a Schedule III drug. More needs to be done, such as completely descheduling cannabis.

A public comment period is underway after the Justice Department published the proposed rescheduling rule. The public comment period runs through July 22, 2024, and comments can be submitted electronically through their portal. Now is the time to add your comments.

Changes in the NYS Office of Cannabis Management and Cannabis Control Board

A lot has happened regarding the NYS Office of Cannabis Management (OCM) and the Cannabis Control Board (CCB). As May unfolded, we learned of the impending departure of Chris Alexander, Executive Director of the OCM, effective June 7, 2024.

In addition, NYS Governor Kathy Hochul mandated several significant operational changes to the OCM for the short and long-term. The changes came on the heels of the final report that Jeanette Moy, Commissioner of the Office of General Services, issued after her 30-day research mission of the OCM.

The operational changes will have an impact on several aspects of what the OCM manages including:

  • A new task force to deal with illicit cannabis activity
  • Licensing procedures
  • Capital for justice-involved CAURD licensees

New Jersey Cannabis Regulatory Commission

Governor Phil Murphy also instituted some major changes at the the NJ Cannabis Regulatory Commission (CRC) in May. Executive Director Jeff Brown is transitioning to a new position at the NJ Department of Health (DOH) where he will be the new deputy commissioner. His replacement at the CRC will be Christopher Riggs, who previously held the role of deputy executive director and was formerly chief counsel of the CRC.

New Jersey senators approve bill for cannabis regulators to oversee intoxicating hemp-derived products

 

 

New Jersey senators approved a bill, NJ S3235, that would extend the oversight of cannabis regulators to include intoxicating hemp products. The proposed legislation would establish regulations for the production and sale of hemp products containing less than 0.5 mg THC per serving, effectively bringing them under the purview of the state’s Cannabis Regulatory Commission (CRC)

 

Under the new bill, these products would be exclusively sold in licensed dispensaries alongside cannabis. The legislation also seeks to amend the existing NJ Farming Act to impose limits on THC content in hemp products.

 

“The main intent… is that there is a phenomenal amount of unregulated, unlicensed, untested cannabis products on gas station shelves and convenience store shelves, and they don’t go through any regulated process.” said Scott Rudder of the New Jersey CannaBusiness Association about the legislation. “Teens have access to this, and this bill attempts to capture that to prevent that.”

 

 

New Jersey bill would allow state officials to cap medical cannabis prices

 

 

NJ Sen. Troy Singleton (D-7) introduced legislation that would grant the CRC the power to implement price caps on medical cannabis products if necessary. Modeled after Pennsylvania’s statute, the bill empowers the commission to intervene when prices are deemed “unreasonable and inconsistent” with actual costs, allowing for price adjustments at six-month intervals.

 

The price of medical cannabis has long been an area of focus for patient activists in the state. New Jersey’s medical cannabis prices were among the highest in the United States for several years. While they have decreased since adult-use cannabis stores began to open, average prices are still higher than they are in other states.

 

Chris Goldstein of NORML, who tracks cannabis prices in New Jersey and Pennsylvania dispensaries, said it’s been difficult to watch legal cannabis in other states become more affordable while NJ’s prices remain sky-high.

 

“Unfortunately, we’ve been sold the same promises for almost 13 years that prices would come down, and there was more competition and more businesses, but the same businesses have been here the whole time, and prices remain remarkably similar,” Goldstein said to Marijuana Moment.

 

 

NYC Mayor Eric Adams orders the closure of 75 unlicensed cannabis shops

 

 

A joint task force led by the New York City Sheriff’s office led to the closure of 75 unlicensed dispensaries in New York City, totaling more than 3,800 violations and nearly $6 million in civil penalties.

 

Called “Operation Padlock to Protect,” the joint operation between the NYPD, the sheriff’s office, and the New York City Department of Consumer and Worker Protection (DCWP) conducted 150 inspections across four days in early May. The results of the operations were announced on May 14th.

While not insignificant, the enforcement efforts are a drop in the bucket. According to city agencies, there are an estimated 8,000 unlicensed cannabis shops across the five boroughs.

 

 

PA GOP senator says the state is ‘getting close’ to legalization

 

 

Senator Dan Laughlin (R-49) asserts that the Keystone State is edging closer to the long-awaited legalization of cannabis. However, Laughlin emphasizes that achieving this milestone requires collaborative efforts from key stakeholders, urging House and Senate leaders to engage in constructive dialogue with the governor to reach a consensus.

 

Speaking at a rally organized by ResponsiblePA, Laughlin joined forces with Senator Sharif Street (D-3) and other advocates to champion the push for legalization. He highlighted regional dynamics and recent federal rescheduling actions as catalysts for momentum, but noted that the Pennsylvania legislature is still several steps away from more action.

 

“We’re getting close, [but]…I don’t think we’re going to get this done until the leaders of the House and Senate sit down with the governor of Pennsylvania and work it out,” Laughlin shared.

New York State (NYS) Governor Kathy Hochul and the NYS Legislature vowed to support and fund the closures of the illicit cannabis smoke shops across NYS and New York City (NYC) – and they have included funding in the 2025 NYS budget to do it. The approved budget that was passed this April vows to shut down illegal cannabis operations. An immediate action of this approved budget is that NYC Mayor Eric Adams is getting the immediate authority to use New York City’s enforcement powers to inspect, issue violations, and seize cannabis and padlock stores.

 

“New Yorkers are fed up with illegal smoke shops and their unlawful business practices, but our administration worked hard to make our voices heard in Albany, and working with Governor Hochul and our state partners, we are proud to say we got it done. New York City will finally be able to use the full force of the law to inspect, enforce, and shut down illegal dispensaries. These measures, combined with our already robust enforcement efforts, will help keep the playing field level and push back against the quality-of-life issues that have resulted from the proliferation of illegal smoke shops. We will continue to work with our partners in Albany to give aspiring entrepreneurs, especially those who have been justice-involved, a chance to succeed.”

NYC Licensing News

This month, the NYS Office of Cannabis Management (NYSOCM) was given the authority by the Cannabis Control Board (CCB) to issue 101 new provisional adult-use licenses to applicants across several segments of the supply chain including: retailers, microbusinesses, cultivators, processors and distributors. The measure was granted during an April 11 meeting of the CCB. This new authority allows the NYSOCM to grant  provisional licenses faster but ultimately, the CCB will still have to approve the final license.

The latest news from the NYSOCM for April includes the stats below since March 2021 when the NYS Marijuana Retail and Taxation Act (MRTA) passed:

  • Total Legal Revenue Sales have reached an impressive $263MM
  • 403 Adult-use Licenses have been awarded
  • Approximately 7,000 jobs across NYS have been created

This April 2024 marks a 3-year milestone for the New Jersey Cannabis Regulatory Commission, while celebrating a 2-year milestone for recreational cannabis sales. As part of their impressive achievements, in 2023 the NJCRC reached over $800MM in cannabis sales and expects to reach $1B in 2024.

Federal Regulatory News: Descheduling vs. Rescheduling

The buzz about descheduling and rescheduling of cannabis continues and will continue until the DEA makes a decision. Among the latest developments around descheduling is the formation of a legislative group who are pushing to have marijuana removed from Schedule 1. The group sent a letter requesting the descheduling to Attorney General Merrick Garland and to Anne Milgram of the DEA.

This month, we feature a brief interview with Dawne Morris, Co-Founder and CEO of Proteus420, an online enterprise resource planning (ERP) system for the cannabis industry. Dawne is a nationally-recognized cannabis entrepreneur who has been named a Top Women to Watch in Marijuana Venture magazine.

An entrepreneur, a technologist and an advocate, Dawne is a champion of our industry, of women and of the cannabis community. We share our conversation below.

CWCBExpo – Did you ever doubt yourself and how did you overcome that self-doubt?

Dawne – Being a woman in the predominantly male sectors of cannabis and technology has presented numerous moments where self-doubt could have crept in. However, I make it a point not to entertain those doubts. As a professional at the helm of a business, my focus is on running my company efficiently; I don’t have the luxury of time to prove myself to others. Whenever I face uncertainty, I rely on my expertise and knowledge, reminding myself of the path I took to get here. My primary aim is to stay focused and achieve my goals—recognition from others, while appreciated, is secondary.

CWCBExpo – Who was your role model growing up and what impressed you most about that person?

Dawne – My greatest influence has undoubtedly been my father, a skilled cannabis grower who deeply educated me about the plant’s healing potentials. Growing up as a proponent of cannabis, we were cautious to keep our discussions within the home due to potential backlash. Unfortunately, my father passed away six years ago, and expanding our business into the cannabis sector has been a way to honor his legacy. It’s not just about business growth; it’s about continuing his advocacy and educational efforts in a field where I truly thrive. As the world became more accepting of cannabis, my husband and I recognized the opportunity to integrate this personal mission into our professional endeavors.

CWCBExpo – Who is your best friend – OK – who are your “2 besties”?

Dawne – My husband David is undoubtedly my best friend. We’ve experienced so much together, and each morning I wake up eager to face new challenges and adventures alongside him. Additionally, I consider my granddaughters as my other best friends—so technically, I have three best friends. They inspire me daily to be a better person, someone they can admire and learn from. Watching them grow has been one of the greatest lessons of my life, and I cherish every moment with my three best friends!

CWCBExpo – You have been a champion of women, tech, and cannabis as you worked your way up, and you are a true believer in community. What advice do you have for women entrepreneurs in our industry?

“This journey isn’t always easy, but it is rewarding, especially when we lift each other up and champion each other’s successes.”

Dawne – I’ve always been passionate about supporting women in tech and cannabis, industries where we are still underrepresented. My advice to women entrepreneurs in our industry is encapsulated beautifully by Maya Angelou, who said, “Without courage, we cannot practice any other virtue with consistency. We can’t be kind, true, merciful, generous, or honest.” This underscores the importance of courage in our endeavors. It’s crucial to stay true to yourself and remember that you are here for a reason. Your unique insights and contributions are incredibly valuable.

I encourage women to actively connect with and uplift other women in the space. Building a supportive community is not just about networking—it’s about creating a space where we can all thrive. Never let your identity be a barrier. Instead, let it be your strength and your guide as you navigate your path. Remember, by supporting one another, we create a stronger, more inclusive industry. This journey isn’t always easy, but it is rewarding, especially when we lift each other up and champion each other’s successes.

Licensing News

On March 11 the Office of cannabis Management issued the Adult-Use December Queues on the OCM website. There were five queues made from a random sequence process for each type of license for applications submitted within the application window that ended December 18, 2023. The queues represent a review order for the OCM itself and do not represent the order in which licenses will be issued. Furthermore, inclusion in a queue does not guarantee getting a license. The five queues were audited by a third party. There are queues for:

  • Cultivator
  • Processor
  • Distributor
  • Retail Dispensary
  • Microbusiness Applicants

Also noteworthy in March, the OCM issued a listing of what they call a Proximity Protected Locations Map (PPLM). The intention with this is to provide transparency on locations of licensed cannabis dispensaries, as well as those proposed locations on applications that are still under review. Proposed locations have what is called proximity protection since the OCM reviewed the locations and have deemed them compliant regarding distancing and proximity requirements until the final determination on a application is made. The PPLM is meant to be a helpful aid to identify potential locations for a cannabis dispensary.

In our February Newsletter, we highlighted the positive reports that the New Jersey Cannabis Regulatory Commission gave about the number of opened dispensaries and the revenue to date for medical and recreational sales. The news just keeps getting better.

The combined revenue for medical cannabis sales and recreational sales since recreational went into effect April 2022 is already over $1.3B to date. The expectation is that in 2024, medical and recreational sales could see over $1B in combined sales.

Virginia News

Governor Glenn Youngkin Does Not Want to Legalize Adult-Use Cannabis

The suspense is over. Governor Glenn Youngkin vetoed the piece of legislation that was passed in late February by both the Virginia state General Assembly and the state Senate to launch a Virginia Adult-Use cannabis industry. The Adult-Use Cannabis Sales bill would have taken effect in May 2025 and sought to build a legalized commercial adult-use market in Virginia. Youngkin made some strong statements about the legislation that he vetoed.

In addition, Youngkin’s veto power did not stop at just one cannabis bill. He also vetoed a bill that would have allowed individuals who were incarcerated for certain marijuana offenses to receive automatic re-sentencing hearings and have their punishments adjusted. No dice.

Lastly, it seems that Youngkin’s views are simply not in step with the majority of Virginians and their views on cannabis and legalization as suggested by a poll released earlier this month by the Institute for Policy and Opinion Research at Roanoke College.

Hawaii has advanced several cannabis legislation bills that seek to expunge tens of thousands of cannabis convictions. The proposals spelled out some legislation to create an adult-use market in Hawaii.

Descheduling vs. Rescheduling

The industry has been abuzz for weeks with the prospect of rescheduling and with even louder calls for descheduling. Several important things that deserve highlighting include:

  • President Biden’s comments made during his State of the Union Address in February where he asserted his support for cannabis reform.

     

  • Vice President Kamala Harris’s meeting this month in March, where she met with several industry influencers, stakeholders, and some who received pardons for cannabis offenses. Included in the notable attendees were hip hop artist and rapper Fat Joe, and Chris Goldstein, Regional Coordinator for NORML. Harris made comments that were bold and welcomed by those in the room and gives a positive prospect for real action by the Federal Government.

Judge Rules for NYS in Lawsuit

NYS has gotten over another hurdle in court. On February 2, Judge Nardacci ruled against plaintiffs citing unfair issuance of licenses that was based on the social equity criterion laid out in the Marijuana Regulation and Taxation Act passed on March 31, 2021. Previous lawsuits claiming similar complaints were settled. The result of the latest ruling by Judge Narducci is a good sign that NYS is continuing to move the industry forward.

Plan to Shut Down Illicit Cannabis Operations

In our January 2024 Newsletter, we noted that Governor Kathy Hochul is committed to shutting down illicit cannabis shops across New York State. The movement to get this done has taken off in recent weeks with several local lawmakers at the NY Assembly and Senate levels supporting legislation and funding targeted at the closing of illegal shops and providing more authority to NYC Mayor Adams and the NYPD to get the job done.

Queens Assemblywoman Jenifer Rajkumar has aggressively been pushing her proposal to shutter illegal cannabis operations across the city, while Queens Senate member Leroy Comrie has pushed to get the law into the budget. It is called the Smoke Out Law.

Licensing News

Some good news for NYS revenues: NYS’s total adult-use cannabis sales are climbing toward $200MM since MRTA was passed. As of this month, total adult-use sales reached $183MM, as reported by the Office of Cannabis Management and Governor Hochul.

Also this month, the NYS Office of Cannabis Management (OCM):

  • Issued over 100 licenses in mid-February including 38 new Retail Dispensary Licenses, and 26 Micro-business Licenses.
  • Approved Home Grow Cultivation Regulations
  • Opened a new application window for more type 3 processor applications and to allow conditional cultivators and processors to continue transition to non-conditional licenses

New Jersey Closes in on $1B in Total Cannabis Revenue

The New Jersey Cannabis Regulatory Commission (NJCRC) reported on February 15 that there were 102 medical and adult-use dispensaries across the state. In addition, total sales for medicinal and adult-use cannabis sales were closing in at $1B combined. These milestones are very good news.

Governor Josh Shapiro Wants to Legalize Adult-Use Cannabis

Will Pennsylvania legalize adult-use cannabis anytime soon? Governor Ron Shapiro is supporting it and presented some key points during his February budget presentation as part of his efforts to legalize adult-use in PA. In his presentation he cited estimated cannabis revenues, social equity, and expungement of minor cannabis offenses and arrests. Not all groups in PA are supportive of the Governor’s efforts.

We highlighted in our January newsletter that the issue of de-scheduling vs. rescheduling cannabis as a Schedule 1 drug was heating up. A poll found that the call to de-schedule cannabis is overwhelmingly supported by both Democrat and Republican voters. The results of a poll featured in NORML.org, compiled by The Tarrance Group, showed that well over 50% of respondents want to see full legalization in all 50 states.

Ukraine’s President Zelensky Signs Medical Cannabis into Law

On February 15, President Volodymyr Zelensky signed the December 21, 2023 bill that was approved by Ukraine’s Parliament. This new law will provide access for medical patients seeking treatment for a variety of conditions including PTSD. The war has created the need for medical cannabis to help treat the traumas of the war suffered by soldiers and citizens. Patients will need a prescription from a doctor to get the medical cannabis and to legally buy it. Recreational cannabis remains illegal. The new law takes effect in July 2024.

Cannabis Revenue Report

The Office of Cannabis Management has issued their 2023 Annual Report. In the report, retail cannabis sales revenue for store fronts is detailed as of December 9, 2023. The document is well-organized, convenient to read through and is available for download. In addition, the report details facts, stats and information about licenses issued in 2023, legal dispensaries, the social equity program and many other topics.

Eradicating Illicit Cannabis Operations

On January 9, 2024 Governor Kathy Hochull outlined in her State of the State Address that NYS is firmly committed to supporting legal cannabis shops and shutting down illegal cannabis operations across the state. Hochul outlined the goal:

“As we continue to build and expand the most equitable legal cannabis market in the nation, we cannot let the brazen, illegal operators undermine public health and threaten our neighborhoods,” Governor Hochul said. “Last year, we passed new laws to padlock and shut down illegal operators, but we know there’s more to be done and we need more tools to do it. We’re going to continue working with local leaders, including in New York City, to shut down illegal cannabis stores once and for all.”

Hochul proposed new legislation that:

  • Cracks down on ilicit cannabis store fronts and closes them down
  • Expands the powers of the OCM to combat illicit cannabis operations including authorizing local governments to padlock them

Cannabis Potency Tax

Also on Hochul’s cannabis to-do list was a proposal to reform the cannabis potency tax to be reduced to a flat 9% excise tax. The potency tax is an onerous tax that makes legal cannabis very expensive and deters buyers from going into legal dispensaries to buy products. This proposal tries to address that.

NJCRC Says Consumption Lounges are Coming Soon

More good news from the New Jersey Cannabis Regulatory Commission (NJCRC) regarding consumption lounges. On January 18, 2024, the NJCRC issued the guidelines for consumption lounges and how they can be part of an existing dispensary. What is appealing about the NJCRC guidelines is that the fees to add a consumption lounge to one’s dispensary appear reasonable.

First Year Adult Use Sales Revenue

January 10, 2024 marked the first full year since adult-use sales began in Connecticut yielding a combined sales revenue of $274 million for adult-use and medical cannabis.

“One year ago, the state of Connecticut opened an entirely new market, creating jobs, opportunity, and a safe, regulated way for adults to purchase cannabis,” said DCP Commissioner Bryan T. Cafferelli. “This was no small task, and the team at DCP launched this new market in a thoughtful, measured way. Since then, many new businesses have opened and more are on the way. We are proud of the work carried out by our agency over the past year, and we are looking forward to continued growth, fair regulation, collaboration with our sister agencies, and thoughtful problem solving as new challenges present themselves in the years to come.”

Rescheduling

The issue of rescheduling cannabis from a Schedule I to a Schedule III classification has heated up this month since the department of Health and Human Services (HHS) released unredacted documents which revealed that the HHS has a clear position recommending that the Drug Enforcement Administration (DEA) reschedule it to Schedule III. In addition, the unredacted documents discusses quite explicitly that cannabis has medicinal use. The unredacted documents provide an inside look at what the HHS was really thinking to reach the recommendation they made to the DEA.

Twelve Attorneys General Ink Letter to DEA

Also this month, Colorado Attorney General Phil Weiser led eleven other Attorneys General to sign a letter calling on the DEA to reschedule cannabis and stating that they are supportive of the HHS’ recommendations to reschedule it from Schedule I to Schedule III. The states joining Colorado were New York, New Jersey, Connecticut, Delaware, Massachusetts, Pennsylvania, Oregon, Nevada, Rhode Island, Illinois and Maryland.

8 Cannabis Statistics, Sales Trends, and Projections for 2024

In the fast-paced, constantly evolving, never-stop-to-rest cannabis industry, there’s a palpable sense that things are growing — but sometimes it can be hard to tell exactly how or in what way. In those moments, it can be helpful to pause, take a breath, and review the data.

Whether you’re planning for the future of your cannabis business or trying to better understand your target customers, data can be a helpful tool but also a tricky thing to parse. To help you, Cannabis World Congress and Business Expo (CWCBExpo) has curated this list of important cannabis statistics, trends, and projections you should be aware of as you grow your cannabis business in 2024. The data below was sourced from Equio, New Frontier Data’s cannabis industry database, unless otherwise noted.

1. Consumers still choose flower most, but product types are diversifying

In the U.S., smokeable flower remains the most popular, with around 78 percent of consumers saying they partake in that product type. Edibles are a relatively close second, with 57 percent of consumers opting to eat or drink their cannabis products. Just shy of one-third of cannabis consumers buy disposable vaporizers or vape carts, making this product category a distant third in terms of popularity. Topicals and tinctures appeal to 26 percent of consumers, while extracts and concentrates are chosen by 22 percent.

How do these preferences translate to sales? In December 2023, flower made up 43.56 percent of all cannabis product sales in the U.S., making it the clear leader by a wide margin. Vape products drove the second most sales at 28.3 percent; although only 32 percent of consumers choose vape products, they buy a lot of them quite often. Edibles drove only 12.36 percent of sales despite their popularity among most consumers.

In terms of money, the average value per transaction is highest when consumers choose flower at $82.31 per transaction. Vape products are a close second at $73.66, and tinctures are neck and neck at $73.52. Extracts follow behind at $69.58, with edibles at $58.36 and topicals at $51.95 per transaction. Pre-rolls generate the smallest average transaction value at $38.04, but they make great impulse purchases to help boost a shopper’s cart size.

2. The American cannabis consumer population is on the rise

As cannabis normalizes and new product types like beverages feel easier for some consumers to embrace, the population of cannabis consumers is growing. An estimated 54 million people in the U.S. identify as cannabis consumers, which is more than 16 percent of the national population. In New York alone, the total addressable market (TAM) consists of more than 3.3 million people, meaning there is a ton of opportunity for cannabis entrepreneurs in the Empire State. In fact, New York joins major markets like California in terms of potential for cannabis businesses.

3. More American adults will have access to legal cannabis than ever before

Thanks to the success legal cannabis has had at the ballot box, there are now 38 states plus Washington D.C. with legal medical cannabis programs of some sort. Out of those states, 18 of them along with the nation’s capital have legalized cannabis for adult use. That means 44 percent of American adults now have access to cannabis for any purpose, while 71 percent have access to medical cannabis. In 2024, these numbers are poised to increase, with states like Pennsylvania, South Dakota, Hawaii, and Florida considering adult-use legalization.

4. More than 7,000 dispensaries are operational in the U.S.

While the majority of these dispensaries are clustered in the west, the number of shops operating on the east coast is growing as the region’s legal cannabis industry catches up with the nation’s pioneering states. In New York, for example, the number of adult use dispensaries is now steadily climbing, surpassing 50 in early 2024 following the lifting of an injunction that suspended the Conditional Adult-Use Retail Dispensary (CAURD) license program and the state opened its doors to large multistate operators (MSOs). 

5. Friday is the most lucrative day for U.S. cannabis dispensaries

Cannabis consumers shop the most on Fridays, during which cannabis retailers generate nearly one-fifth of their weekly revenue as shoppers look to stock up for the weekend. The next busiest day is Thursday, when 15.24% of dispensary revenue is realized, closely followed by Saturday at 15.21%. Sunday is the quietest day of the week, but it still accounts for more than 10 percent of dispensaries’ weekly revenue.

6. The regulated market won’t surpass the unlicensed market — yet

The total legal cannabis market in the U.S. is projected to reach $35.16 billion in 2024, with the adult use market contributing $22.4 billion and the medical market $12.72 billion. The legacy market will remain on top this year by a significant sum at $70.9 billion. That means roughly half of the country’s cannabis market remains unregulated, though that share is projected to fall every year. At the current pace, the regulated market would surpass the legacy market in 2029.

7. The cannabis industry is expected to grow 12.84% through 2029

The legal cannabis industry’s compound annual growth rate (CAGR), a measure of how quickly an industry expands over a certain period of time, is projected to be 12.84% from 2024 to 2029. If those projections are accurate, the total legal market will grow to $62.72 billion in 2029. The adult use market would make up $50.29 billion of that value, with medical cannabis driving the remaining $12.43 billion. Projections suggest the legacy market would still represent a total $56.33 billion in 2029.

8. Global legalization will continue to expand

The world is becoming more cannabis-friendly each year, and that won’t stop in 2024. Currently, there are eight countries that have legalized adult use cannabis and established a framework for adult use sales to begin. Notably, the U.S. is represented as one such country in the graphic below due to a majority of its states supporting adult use sales, even though cannabis remains federally illegal. 

Aside from these countries, five others have legalized adult use cannabis without establishing a framework for sales to begin. An additional 17 countries have established a medical cannabis program, while 41 more have some form of cannabis legalization in limited circumstances. Access is expected to expand as countries that have legalized set up regulatory frameworks for sales to begin and additional countries consider legalization measures, including Thailand, Colombia, and Switzerland.

The future continues to burn bright for cannabis

In cannabis, we’re all used to challenges. However, we persevere because we believe in this industry and this plant, and the data shows that our belief is not misplaced. The trend toward a successful, thriving, global cannabis industry has never been clearer.

The Office of Cannabis Management and the Cannabis Control Board regulators voted on November 27 to settle the two lawsuits that held up hundreds of Cannabis Adult Use Retail Dispensary (CAURD) card holders from actually opening up their dispensaries. The temporary injunction put forth was lifted for the two lawsuits and gave the green light to the 436 licensees to finally move forward. At least 23 of those CAURD holders were ready months ago before the injunction and can now proceed.

Governor Kathy Hochul expressed that NYS is committed to supporting legal cannabis shops and shutting down illegal cannabis operations.

First Dispensary Opened in Mt. Vernon, Westchester

Congratulations to Elevate Cannabis, the new and first legal recreational use dispensary to open up in Westchester County in Mount Vernon, New York. The dispensary opened its doors in early December and offers delivery services as well as in-store cannabis retail experiences. Elevate Cannabis is mission-oriented and is supportive of social equity causes, healing and related quality of life issues.

NJCRC Announces Reduced Fees

The New Jersey Cannabis Regulatory Commission (NJCRC) announced some good news for medical cannabis patients and their caregivers. Instead of the $50 per year for most registrants and the $20 for seniors to register in the Medicinal Cannabis Program (MCP), it is now $10 for everyone as of December 7, 2023. Plus, patients and caregivers will be able to receive free Digital ID cards or pay $10 for a physical card.

Putting cannabis business to good use and making a difference

NJ Governor Jim Murphy and Attorney General Matthew Platkin announced anti-violence measures that will be funded with $15MM, of which $5MM is coming from marijuana revenue. The program is being funded by the Fiscal Year 2024 Appropriations Act and includes $5 million from the Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Fund.

President Joe Biden issued a Proclamation on December 22nd for those individuals with certain federal level marijuana convictions. “I am issuing a Proclamation that will pardon additional offenses of simple possession and use of marijuana under federal and D.C. law,” the President stated. This recent action expands the pardons that President Biden had made previously.

Germany’s Cannabis Legalization Delayed

Germany was set to legalize cannabis starting as soon as the new year but has been delayed until well into 2024 according to the German Health Minister, Karl Lauterbach. Germany appears to have a well-thought out and well debated cannabis legalization plan that includes cannabis social clubs and modifications to home grow regulations.

Ukraine’s Cannabis Bill Expected to Pass Early 2024

In our July Newsletter we highlighted that Ukraine’s President Volodymyr Zelensky is in favor of legalizing medical marijuana, and that the country’s legislature was poised to do so until an opposition faction blocked its passage. It is expected that this opposition will be overcome and the bill will pass in January 2024, and the law will become effective six months later.

SPECIAL FEATURE: Interview with Ken R. Weinberg, MD (Part 2)

We are excited to share Part 2 of our “Cannabis as Medicine” interview with Ken R. Weinberg, MD, Chief Medical Officer and Founder of Cannabis Doctors of NY.

This month our discussion focuses on the medical marijuana market and medical marijuana patients and how adult-use legalization is affecting medical use.

Ken Weinberg, MD

Ken is a practicing physician with decades of experience in emergency medicine and urgent care. He is a published author of medical articles across many disciplines and is currently working on a book about his experiences in front-line medicine, including the 1500 or so patients he has seen as a registered Cannabis Practitioner since 2016. He is the Founder of Cannabis Doctors of New York.

Among his many medical commitments, he serves as the Attending Cannabis Consultant at Inspir – a private nursing home in New York City. At that facility he provides medical expertise and guidance for elders who are interested in using cannabis as part of their medical care. Ken works with several dispensaries in the New York area as well.

INTERVIEW, PART 2: CANNABIS AS MEDICINE

CWCBExpo – Recently, the New York State Cannabis Control Board approved six of the state’s Registered Operators (ROs)* to participate in the adult-use market. What do you think about this and how do you think it will affect the medical cannabis marijuana market for patients and appropriate patient care? Will it help? Are you concerned for patient care and are you concerned that new users who would have otherwise consulted with a medical practitioner will now not be getting the optimal medical advice?

Ken – I have mixed feelings. The fact that many of our medical patients are opting to go to the rec market has caused a precipitous drop in medical patients. And while I am sure that some of the people who have made the switch will do okay, one of the reasons I like the NY medical cannabis space is that there are pharmacists involved. Cannabis medicine is medicine, with exact dosing, possible drug interactions and effects that budtenders should not be opining on.

*Editor’s Note: Medical dispensaries (ROs) must have a registered pharmacist to dispense the medical marijuana to patients. There is also a requirement that any RO who is approved for participation in the adult-use market must have a separation of the medical marijuana and the adult-use retail sections.

CWCBExpo – Describe your recent presentation to a Northwell Resident group regarding educating them on cannabis as a medical treatment. Were there any particular conditions, diseases or symptoms that you focused on in the presentation? What was the reaction of the medical residents who attended the presentation – was it well received?

Ken – For the last three years, I’ve been giving this lecture to the Family Practice residents. I talked about the Endocannabinoid System and similarities of the plant cannabinoids to the endogenous (produced inside the body) cannabinoids.

I spoke about how well my patients with autoimmune diseases (like Inflammatory Bowel Disease) do and about how I am seeing how very beneficial cannabis can be for patients with dementia. This was the best received talk I’ve given and I suspect I left them (and an initially skeptical Attending Physician) wanting more.

CWCBExpo – What do you think about Psychedelics as treatment for many medical conditions? Where do you see this going?

Ken – I think this is a huge, burgeoning area of medicine with great potential for benefits. Unfortunately, as with so much else in this country, the fact that they remain Schedule 1 narcotics leads to a hodgepodge of regulations and research in various states, and the federal government unable to provide some uniformity of guidance.

CWCBExpoWhat about micro dosing and the use of psychedelics as a medicine for treatment?

Ken – Micro dosing can be a good way to start, especially for “cannabis-naive” patients and the elderly, who may be very sensitive to the effects. I’m not involved with psychedelics but they seem to be very promising for a variety of conditions.

CWCBExpo What excites you most about practicing medicine and devoting your life to it? And furthermore, what can explain the motivation for you to include cannabis as a medical treatment?

Ken – I am a third-generation MD, and one of three brothers. One brother was a Family Practice and Naturopathic physician, the other an Oriental Medicine and acupuncturist so it feels like it’s in the blood. In fact, my niece is an OB-GYN doc, making her the fourth generation of Drs. Weinberg.

I think that medicine is a field where you can continue to grow, enrich your understanding, and be stimulated intellectually as well as be emotionally gratified even as you advance in age. I love my involvement in cannabis medicine because it provokes me all the time, and challenges me to understand how we interact with the plant, and how it may well be involved (in the best way) with the placebo effect. Lastly, as you alluded to, my love and long involvement with the interface of literature and medicine has caused me to write stories of my patient encounters for many years and has now led to my writing a book incorporating those stories along with the many influences on my life as a political activist doctor and writer.

New Dispensary on Long Island

Congratulations to Little Beach Harvest Dispensary that opened its doors in South Hampton, NY. The Little Beach Harvest Dispensary is owned and operated by the Shinnecock Indian Nation which is a federally recognized tribe living on their traditional lands in Long Island. This opening is a culmination of many years of effort by the Shinnecock Nation. The dispensary will offer adult-use and medical cannabis products to its customers as well as education and community involvement.

Governor Hochul Signs Additional Cannabis Tax Relief

Governor Hochul signed legislation, Senate Bill S7508 last week that allows New York City cannabis business owners and operators to deduct certain business expenses giving NYC cannabis businesses tax relief from the restrictive 280E Tax Code regulation. The newly signed legislation amended the NYC administrative tax code and now permits certain tax deductions related to the sale, production, or distribution of cannabis products.

NYS Regulators and Licensing Lawsuit

Some hopeful news. Several news outlets reported last week that the lawsuit from a group of disabled military veterans against NYS cannabis regulators, i.e., Office of Cannabis Management and the Cannabis Control Board, may be nearing some sort of an agreement that is awaiting finalization and approval by the courts. Once it is approved, it could lift the temporary injunction and allow hundreds of Cannabis Adult Retail Dispensaries (CAURD) licensees to open their doors.

Update on Adult-Use Ballot Measure

On November 8, 2023, the Florida Supreme Court heard arguments regarding an Adult Use Ballot Measure. The oral arguments were heard from both sides, with each getting 20 minutes to present their cases regarding whether or not to add a ballot measure to the General Election on November 5, 2024.

As we asserted in our October Newsletter, the state’s Governor, Ron DeSantis, does not support the measure and neither does the Attorney General, Ashley Moody.

The Florida Supreme Court has until April 1, 2024 to decide on the case. The session where the arguments were heard “for” and “against” the Adult-Use Ballot Measure measure can be viewed on this YouTube video link. It really is a very interesting watch.

Ohio became the 24th state to legalize and regulate possession, home cultivation, retail sale of cannabis for those 21 years and older. Ohio is expected to bring in hundreds of millions of dollars in tax revenue if they do vote to legalize, according to an economic impact study done by Ohio State University.

Looming on the heels of Ohio voters making their decision at the ballot box, Governor Mike DeWine wants to tweak the laws.

Japan Allows Cannabis Derived Medical Products

Japan’s Lower House passed a bill last week that allows medical products derived from cannabis, while reinforcing other marijuana products that are banned. The bill also seeks to revise other laws related to cannabis. A known product, Epidiolex, approved for use in the United States and in Europe to treat epilepsy, is under a clinical trial in Japan. This bill may pave the way for its approved use in Japan.

Portugal is breaking records regarding how much medical cannabis it exports to other European countries. This year, it is expected to surpass the 2022 levels of exports which reached 9,271 kg. Portugal’s international medical cannabis trade has many benefits that positively impact its economy.
