Safeguarding the Green: Cannabis and Cybersecurity 

The rapid rise of the cannabis industry is certainly turning heads — but not always the right ones. The industry’s lucrative rise has also drawn the unwanted attention of cybercriminals looking for ways to steal data, credit card information, and other sensitive information. What sort of precautions should cannabis companies take to guard against cybersecurity threats?

What is a cybercrime?

Cybercrime encompasses a range of illegal activities conducted through computers or internet networks. Cybersecurity threats, in particular, include but are not limited to credit card fraud, unauthorized use of personal data, ransomware, and more. 

Cybersecurity statistics indicate that there are 2,200 cyber attacks across all industries daily, with an attack happening every 39 seconds on average. In the U.S., a data breach can cost a business an average of $9.44 million. Cybercrime is predicted to cost companies as a whole $8 trillion by 2023.

What is cybersecurity?

Cybersecurity can be defined as the protection of networks, devices, and data from unauthorized access or criminal use. Generally, it involves the implementation of security protocols, advanced technologies, and proactive strategies to ensure the confidentiality and integrity of digital assets. This is especially relevant for many cannabis companies that collect sales data, patient information, and payment information, among other types of sensitive data.

There are many different types of cybersecurity measures, but the three most common are firewalls, intrusion detection systems (IDS), and antivirus software. These systems act as digital guards, scrutinizing all incoming and outgoing network traffic and unauthorized activity. 

Why is the cannabis industry targeted for cybercrime?

There’s a lot to think about when it comes to cybersecurity and cannabis. To understand if you’re at risk or not, you must look at things from the viewpoint of the cybercriminal. Here’s why cannabis remains a targeted industry: 

  • It’s new: The cannabis industry is still in its infancy. Unlike more established sectors, there are fewer precedents for safeguarding digital assets in cannabis. This makes it less of a priority for companies to implement comprehensive security measures.

  • Businesses are small: Many cannabis businesses are first getting off the ground. In these beginning stages, cybersecurity measures are not always given the same attention as physical security, compliance, and marketing. This often translates to limited investment in cybersecurity, leaving these companies more exposed to attacks.

  • Private information is lucrative: The personal nature of cannabis consumption and shopping makes it an attractive target. Information related to purchase history and patient data is valuable to cybercriminals, driving them to target the cannabis industry specifically. 

How can you keep your cannabis business safe from cyberattacks? 

Although cannabis businesses may be a target, you can still take important steps to protect yourself and your business. A few key considerations to keep in mind for protecting your business include: 

Risk assessment 

The first step to protecting your business from potential cyberattacks lies in risk assessment. By identifying potential vulnerabilities and understanding the specific risks that the industry faces, companies can proactively implement targeted security measures to secure their digital infrastructure. Some of the key basics for a cybersecurity risk assessment plan include: 

  • Define and assess potential threats: This initial step lays the foundation for a comprehensive risk assessment by identifying various threats that could impact your business. Evaluate the potential damage or harm that could result from each of these threats and prioritize what requires immediate attention.

  • Identify your security vulnerabilities: Pinpointing vulnerabilities within your system and processes is crucial. This will help you to understand where potential weaknesses lie and where protective measures are needed.

  • Calculate risk levels: Assessing the probability of each identified threat occurring allows you to allocate resources appropriately and focus on the most probable risks to ensure adequate security measures. 

Staff training 

Educating your team about cybersecurity is a crucial line of defense. With the proper knowledge and awareness, employees become an integral part of your security strategy. Training sessions can cover best practices, recognizing phishing attempts, password protection, and the importance of reporting suspicious activity. This human firewall can significantly increase your cyber protection. 

Secure systems 

Implementing robust security measures across your digital platforms is paramount to protecting your brand. This includes adopting encryption protocols, utilizing firewalls, and regularly updating software and your website so attackers cannot take advantage of known problems or vulnerabilities. Access control and authentication mechanisms and policies also ensure that only authorized personnel have access to sensitive information and data. 

Backup strategy

A comprehensive backup strategy is a critical aspect of cybersecurity. Regularly backing up essential data ensures that information can be swiftly restored in the event of a cyber incident, minimizing downtime and loss. Employing both onsite and offsite backups, along with routine testing of recovery processes, is essential to maintain security for your business. 

Response plan 

Despite best efforts, breaches may occur. Having a well-defined response plan is essential. This includes clear steps for incident reporting, a designated response team, communication protocols, and a chain of command for decision-making. Many companies rely on what is known as a “cyber incident response plan,” a document that outlines what an organization should do in the event of a data breach or cybersecurity incident. A swift and coordinated response can mitigate potential damage and facilitate a smoother recovery. 

Regular review

Cybercriminals consistently find new ways to exploit vulnerabilities. As you create procedures and policies, don’t let them go untouched for months or years. It’s best to evaluate your cybersecurity protocol and overall health on a regular basis. Depending on your risk level, monthly, quarterly, or biannual reviews may be necessary.

Hire a consultant

Just like there are cannabis security experts who work with dispensaries and cultivation facilities, there are cybersecurity consultants who can help you review your business and identify areas that could benefit from strong security procedures. Look for a consultant with specific expertise and experience in the cannabis industry.

Keep your business secure around the clock

The importance of cybersecurity in the expanding industry cannot be overstated. Safeguarding sensitive data and operations is paramount for sustainable growth and success. And cybersecurity does not only involve the steps your company takes for its own policies — it’s the partners you work with as well. So don’t be afraid to ask questions about security when evaluating software vendors and website developers. The health of your business depends on it!

NYS licensing applications process opened and deadline extended

On October 4, the NYS Office of Cannabis Management (NYSOCM) opened the application process for five types of licenses. The submission deadline is December 18, 2023. The five types of licenses are:

  • Adult-Use Cultivator
  • Adult-Use Processor
  • Adult-Use Distributor
  • Adult-Use Retail Dispensary
  • Microbusiness

Five additional NY dispensaries opening up

Five more dispensaries are opening in New York City and in New York State after a judge ruled that these five can get an exemption from a court ruling that temporarily halted the well over 400 licensed CAURD holders from actually opening. There are now 27 adult use dispensaries open in New York State.

In our September Newsletter we highlighted New Jersey’s grant program which was designed to achieve cannabis equity in communities that have been impacted by the war on drugs. On October 5, 2023, the New Jersey Economic Development Authority announced that they awarded $12MM to 48 grant recipients.

A public comment period opened on October 16, 2023. The NJCRC is seeking feedback on their proposed regulations regarding the expansion of cannabis edibles in the New Jersey cannabis market. The comment period ends on December 15, 2023.

The Florida Supreme Court will hear arguments on an Adult Use Ballot Measure – it is set for November 8, 2023

The oral arguments will be heard from both sides, with each side getting 20 minutes to present their cases about whether or not to add a ballot measure to the General Election. This is quite an interesting case since the state’s Governor, Ron DeSantis, does not support the measure and neither does the state Attorney General Ashley Moody.

Shuttered hemp businesses can reopen

In our last Newsletter we highlighted that Maryland had logged millions in cannabis sales since going Adult Rec on July 1. Now the previously shuttered businesses that sold hemp-derived products can reopen due to a recent ruling in October on a case filed by the Maryland Hemp Coalition and other businesses. The lawsuit  has yet to be resolved.

Early voting has started for marijuana legislation

Ohioans started early voting in October. They are now voting on a ballot measure to legalize and regulate possession, home cultivation, and retail sale of cannabis for those 21 years and older. Ohio is expected to bring in hundreds of millions of dollars in tax revenue if they do vote to legalize according to an economic impact study done by Ohio State University.

Keep on truckin’ – truck drivers and cannabis

The latest survey shows support among US truck drivers and their carriers regarding Federal testing rules for marijuana. The survey showed that over 60%  support testing for impairment rather than testing for use. Federal laws dictate that truck drivers are subject to testing before and during employment. With the current testing methods, a urine sample will show marijuana usage for up to a month. Tests reflect use, but not actual impairment. These testing practices have created a shortage of truck drivers with the ripple effect of supply chains being segmented and broken due fewer available drivers.

Switzerland

The first ever legal cannabis dispensaries in Europe will be opened in a major cannabis consumption pilot study between Sanity Group and the Swiss Institute for Addiction and Health Research. There will be two stores: the first will be located in Allschwil, Switzerland and the second in Liestal, Switzerland. The pilot study seeks to gather data about cannabis usage and health, among other things.

CWCBExpo sat down to talk with Leo Bridgewater, US Army Veteran, Entrepreneur, Activist, and CWCBExpo Advisory Board Member.

We discussed the cannabis programs in New Jersey that are geared to help veterans, entrepreneurs and neighborhood Impact Zones that have been affected and harmed by the war on drugs.
In 2001, Leo Bridgewater enlisted into the United States Army in response to the September 11 attacks. There, he spent five years as a Telecommunications specialist with multiple deployments to Iraq. After separating from the Army in 2006, he spent another 2 ½ years working for the Department of the Army at the Pentagon in Washington DC. Having had three battle buddies attempt suicide and two being successful, Leo’s advocacy for veterans’ rights has seen him testify in NJ Senate Committee to have Post Traumatic Stress Disorder (PTSD) added to the NJ Medical Marijuana Program (NJMMP). As a result of his efforts, in September of 2016, NJ Governor Chris Christie signed bill S-2345 adding PTSD to the NJMMP.
Leo has a long history of working with New Jersey legislators on moving the cannabis industry in their state forward. Leo explained that the New Jersey Cannabis Regulatory Commission (NJCRC) and other departments in NJ have developed a program called the Technical Assistance Program (TAP).
We asked Leo about this program in NJ and how it helps veterans and other groups to get started in owning and operating cannabis businesses.

Q: CWCBExpo – What is New Jersey’s Technical Assistance Program (TAP)?

A: Leo – The TAP program is a coordinated initiative and program by the NJCRC, the NJ State Department Business Action Center (NJBAC) and the NJ Economic Development  Authority Department. It is run by NJBAC to provide no-cost technical assistance and training to cannabis license applicants.

TAP is a program that is geared to help applicants in certain categories such as social equity, legacy, diversely-owned and microbusinesses, and Impact Zones. Impact Zones are the hardest hit areas and neighborhoods in New Jersey that have been impacted by the failed war on drugs and have had the highest arrests for minor cannabis offenses.

NJBAC exhibited at the CWCBExpo this past June and they had numerous attendees and businesses looking to get into the NJ cannabis space. It was very beneficial for NJBAC to participate in CWCBExpo.

Q: What sort of assistance does TAP provide for participants who are in the program?

A: Leo – TAP provides business “101” and “102” classes to participants; it also awards financial grants from $150K up to $250K; it provides access to state approved vendors for every aspect of the supply chain, and gives mentoring to help participants be successful.

Q: Are you satisfied so far with how and what groups have been issued cannabis licenses from the NJCRC? 

A:  Leo – According to NJ law, 30% of all licenses must go to minorities, veterans, women, etc., and NJ has exceeded that statute requirement. Furthermore, there is no cap on  cannabis licenses in NJ. So as the rollout continues, the NJ cannabis industry will continue to issue licenses and support those applicants who get them.

In New Jersey, we have a very diligent and dedicated team of people including Dianna Houenou, the Commission Chair of the NJCRC, Jeff Brown, the Executive Director of the NJCRC, and Wesley McWhite III, the Director of Diversity and Inclusion at the NJCRC.

“We need a cannabis vote to be more organized on political grounds. We are asking a bunch of Flintstones to write a game-plan and playbook for a Jetsons game.”

Q: What would you like to see going forward for the cannabis industry on a national level, especially in the context of the recent Health and Human Service (HHS) recommendation to the Drug Enforcement Administration (DEA) to reschedule cannabis from a Schedule 1 classification drug to a Schedule 3 classification drug.

A: Leo – I would like to see more active voters coming out to make sure we elect politicians that are supportive of cannabis and removing entirely cannabis from being illegal at all – just completely remove it – de-schedule it entirely.

C’mon, where do politicians go to ask about cannabis and get answers about the plant? We need a cannabis vote to be more organized on political grounds. We are asking a bunch of Flintstones to write a game-plan and playbook for a Jetsons game. The voters must demand that those we elect are knowledgeable and aware of the plant and making cannabis legal on a federal level.

The New York State Office of Cannabis Management (NYSOCM) will be opening the licensing program and anticipates that they will be issuing 1,500 licenses during the application process which starts October 4.

Note that there are five license types that the NYSOCM will be issuing. Make sure you understand the process.

The five types are:

  • Adult-Use Distributor
  • Adult-Use Retail Dispensary
  • Microbusiness

Here’s some more good news for the East Coast Cannabis markets: The state of Maryland has logged mega millions each month since their adult-use sales started in July. There were no adult-use sales prior to July in Maryland – only medical, and sales were half as much as reported in June compared to July once adult-use sales began. June sales prior to adult-use were just over $42MM. In July they were over $87MM, and in August they were over $91MM. It looks like a steady increase as the adult-use Maryland market develops.

Alaska News

Free samples? Looser ads? Drive-up sales? What is happening in Alaska?

Alaska went adult-use in 2014 but had some stringent rules regarding advertising and taxation. Almost ten years later, Alaska has made some changes which will help support its cannabis industry. The changes reflect easing of rules on a taxation level, the advertising of cannabis, and provide less strict rules and regulations than that of Anchorage.

The state legislators signed changes on September 8, and starting on October 8, the new rules that will go into effect will allow less stringent advertising methods, allow for the issuing of coupons for cannabis products, and allow the give-way of free samples. Alaska could start seeing ads on buses and other public places where ads were previously banned.

Federal News: SAFER Banking Act

Earlier this week, as we close out September, the SAFER Banking Act passed under the Senate Banking Committee with an approval vote of 14-9. Senate Majority Leader Chuck Schumer said he would bring the SAFER Banking Act to a vote on the Senate floor but with the impending government shut down, there is no telling when the full Senate vote would take place.

Australia

In mid-August, the Green Party introduced a cannabis legalization bill to their Federal Parliament with the goal to create a legal cannabis industry across all of Australia. The anticipation is that it would create opportunity for its citizens, bring revenue in the billions to Australia, and codify the fact that Australians widely support legalization of cannabis.

Israel

Israel has eased the medical cannabis rules and laws for patients. Effective in December, patients will be able to get medical cannabis as their first line of treatment for illnesses rather than go through a cycle of traditional treatments first. They will also have access to hemp-derived CBD products.

Green Market Report has reported breaking news:

The Department of Health and Human Services (HHS) did a review, as requested by President Biden, concerning cannabis as a Schedule 1 drug.

The HHS made their recommendation on Tuesday August 29  in a letter to the DEA to reschedule cannabis to a Schedule 3 drug. If this is to happen, the ramifications will be quite meaningful for the cannabis industry.

“The rescheduling move, if completed by DEA, would nullify the impact of the 280E tax provision on marijuana companies, meaning the entire industry could begin claiming standard business tax deductions on their federal returns, saving cannabis companies untold millions in coming years.”  Continue reading in Green Market Report.

In this Newsletter we highlight medical cannabis and elder care. We had the pleasure of sitting down for an interview with CWCBExpo Advisor, Ken Weinberg, MD.

Ken is a practicing physician with decades of experience in emergency medicine and urgent care. He is a published author of medical articles across many disciplines and is currently working on a book about his experiences in front-line medicine, plus the 1500 or so patients he has seen as a registered Cannabis Practitioner since 2016. He is the Founder of Cannabis Doctors of New York. Among his many medical commitments, he serves as the Attending Cannabis Consultant at Inspir – a private nursing home in New York City. At that facility he provides medical expertise and guidance for elders who are interested in using cannabis as part of their medical care. Ken works with several dispensaries in the New York area as well.

We asked Ken how the elders who opt for cannabis as part of their medical treatment at Inspir fare and what is involved in managing those treatments. Below is brief Q/A with Ken.

(Please note that there is no longer a need for a medical card for a patient to get medical cannabis. The prescribing practitioner sends a certification that includes a barcode on it. With the certification the practitioners, patients and/or caregivers and pharmacist at the dispensary, decide which cannabis products would work best for the patients’ needs.)

Q: CWCBExpo – How did you get to be the attending physician at Inspir?

A: Ken – A few years ago, before they’d actually opened their Manhattan facility (they already had one in Connecticut) we made contact with Brian Geyser, a nurse practitioner who is Vice President of Health & Wellness for Maplewood Senior Living. They are the company that runs Inspir. Brian has said that, based on what he has seen about the benefits of medical cannabis over the years, he felt that he would actually prefer if the residents who were living there could use it, instead of the many opioids, psychotropics and other medicines they were on. Brian and I have met many times since then and, when the facility became operational, he suggested that I do a presentation at Inspir. I gave a talk, along with Sang Choi, head pharmacist at the Etain dispensary and Denis Tarant, the nurse practitioner who is the medical director at Inspir, to the residents and staff about it. Since then we’ve been getting referrals and working with the nurses, social work staff, patients and families, and using it often as a first line therapeutic agent.

Q: Tell us how you determine if a patient would do better with cannabis as part of their medical treatment.

A: Ken – Most of the patients I see, whether at Inspir, other Senior Living Facilities or living at home, are often on one or more medications. They will generally come to me because they are not getting the results they want or are unhappy with the side effects they are having. At this point, having seen patients with such a wide range of medical issues, whether chronic pain, auto immune disorders, anxiety, insomnia, or dementia, to name a few, following them in many cases for several years and, knowing how well most of them do, I am happy to do a consult and get them started to see if cannabis might well give them the help they are looking for.

Q: Do you find more or less skepticism among elders regarding cannabis usage as a medical treatment?

A:  Ken – Increasingly I see less skepticism among the elderly. Oftentimes they have been on a panoply of meds over many years, and have reached the end of their rope. So they are willing to try cannabis, despite all the negative things they have heard about it all of their lives.

Q: You did a presentation about Cannabis and Alzheimer’s for CaringKind and they told you that it was the most watched presentation that they had on memory care. What can you say about that presentation and how it opened up the topic of cannabis usage and elder care?

A: Ken – It turns out that there have been studies (though not well publicized ones) going back to the ’90’s where various forms of cannabis have been used successfully for many of the issues that develop when patients have declining cognitive abilities, and exhibit the behavioral problems that go along with them. The current medications approved for, or being studied, to treat dementia have limited efficacy. It turns out that the many, many components found in the cannabis plant seem to be able to address a number of the ongoing degenerative, biochemical processes that cause dementia, without many of the side effects that more traditional pharmaceuticals cause.

Tax Relief for NYC Cannabis Businesses

In the absence of the passing of the SAFE Banking Act or full-blown federal legalization, the NYS Senate approved legislation and provisions for NYC cannabis businesses to take the same business deductions when they file taxes that non-cannabis businesses take on their tax returns.

NYS cannabis business owners have been able to do so since Governor Hochul signed a tax relief legislation for the state level cannabis business owners last year. This new NYS Senate-approved legislation helps to level the tax playing field for NYC cannabis businesses.

NYS Office of Cannabis Management (OCM) Update: Cannabis Growers Showcase Program (CGS)

The summer appears to be productive for the NYS OCM’s Cannabis Control Board (CCB) as they showed their determination to sincerely and actively help move the NYS cannabis industry forward as well as create a program that is meant to help growers.
At the July 19th meeting, the CCB approved a number of initiatives that included:

Creating the Cannabis Growers Showcase (CGS) Program:

  • Allows selling product outside of retail shops at newly created sales programs called “Cannabis Growers Showcases”
  • Needs at least 3 growers at the showcase site with a licensed Conditional
  • Adult Retail Dispensary Licenses (CAURD holder at each CGS)
  • For every 3 growers at the showcase site, 1 processor can sell other cannabis products such as vape cartridges, edibles, and drinkables
  • These CGS sites are meant to allow licensed growers to bring and sell quality products to areas in NY where retail dispensaries are in development and not yet opened

Plus:

  • Approving 212 more CAURD licenses to applicants
  • Aggressively going after the illegal cannabis market
  • New regulations to help safeguard cannabinoid hemp products and public safety
  • Amendments to medical cannabis regulations that are meant to improve patient access and care. (Note that this initiative has a public comment period of 60 days.)
  • Adopting the regulations regarding licenses for researchers and the work they do to help advance the cannabis industry
  • Approval of another NYS testing lab, Coral Reef Labs, in Johnson City, NY

It is imperative that the NYS OCM continue to come up with programs to help growers sell their products as the retail supply chain is developing.

“NY Small Farma” Gathered Local Growers at CWCBExpo’s Growers’ Field

Staten Island’s First Adult-Use Dispensary Opening Soon!

This fall, Staten Island will celebrate the opening of “The Flowery Dispensary” at 3022 Veteran’s Road West in Charleston. This will be the borough’s first legal adult-use dispensary, and CWCBExpo will be there for the opening.

NYS Social Equity Funded by Chicago Atlantic

Last month in June, Governor Kathy Hochul announced that Chicago Atlantic committed to fund $150MM of the planned $200MM goal for the NYS Social Equity Fund that is targeted to financially help and support those who have suffered negative impact by unjust enforcement of cannabis prohibition. This announcement of Chicago Atlantic’s commitment is a great step forward for NYS to get the entire goal achieved.

Dispensary License News

In our last Newsletter we mentioned and congratulated the Co-founders of Earth & Ivy, a New Jersey Dispensary that opened its doors in May in New Brunswick, NJ. 

Since then, the NJ Cannabis Regulatory Commission (NJCRC) has been quite busy working to award more NJ cannabis licenses. This really helped to increase the adult-use retail sales locations in NJ which now is fast approaching almost 50 – the tally sits currently at 45.

CWCBExpo welcomed the NJ Business Action Center (NJBAC) to the show floor this past June.

The NJBAC is a business advocacy team within the NJ Department of State, dedicated to solving problems and maximizing growth opportunities for your business. Maryland’s First Week of Adult Use Sales Tops $21 Million

On July 1st Maryland began its adult-use retail cannabis sales and the dispensaries took in over $10 million in just the first weekend, with the first full week totaling over $21MM. The first year of sales is anticipated to reach $600 million.

Adult Use to Begin August 1st

We congratulated Minnesota in our last Newsletter for becoming the 23rd state to legalize recreational marijuana. On Tuesday August 1, adults 21 or older may cultivate, possess (in certain limited amounts), and use cannabis for personal use. In addition the state will begin the process of reviewing and expunging arrest records for low-level minor offenses involving cannabis.

Ukraine

President Volodymyr Zelensky of Ukraine has expressed his support to legalize medical cannabis use. The Ukrainian Parliament has approved a legislative bill that will go to a second review before Zelensky is expected to sign it. The rules included in this bill and the maturation process for Ukraine’s cannabis legalization will go through many levels of growth and progress just like other countries.

Ever been to Luxembourg? It is a wonderful place to visit. The editors traveled there a few years ago and cannabis was not mentioned ever. Progress, progress, progress – one step at a time.

This July, Luxembourg legalized the cultivation of up to 4 plants in a household by adults aged 18 and up. The plants must be in the home, and not visible to the public. Laws related to public possession and public consumption remain in effect – but progress has to start somewhere.

5 Lessons for Cannabis Entrepreneurs 

The cannabis industry is a hotbed of entrepreneurial activity as new markets open and established ones evolve. Cannabis represents a wealth of opportunities for those who are willing to take risks and innovate, from manufacturers who develop new product types to ancillary services that provide a particular expertise to support flourishing cannabusinesses. 

However, like any industry, there are many pitfalls that entrepreneurs may succumb to, and there are particular challenges in the cannabis industry to be aware of. Much can be learned from other business owners who have experience which could help new cannabis entrepreneurs succeed.

1. Do your research 

As a cannabis entrepreneur, doing your homework is one of the most important steps to take. With the industry still evolving and rapidly changing, it’s critical to stay up-to-date on the latest laws, regulations, and industry trends. Doing your research will not only help you to make informed decisions and avoid costly mistakes but can also give you a competitive edge by helping you identify opportunities in the market. For example, state laws change constantly, and knowing their evolution can help you make savvy, informed decisions about your business.

Resources like the Cannabis World Congress & Business Exposition (CWCBExpo) monthly newsletter, for example, is a great way to stay up-to-date on the latest trends and developments in the industry and connect with other professionals. Other publications, such as Marijuana Moment and Cannabis Business Times, offer valuable insight and information to help you stay informed as well. 

“Find out what has worked and what has not worked and, most importantly, find out what the actual rules are in the state that you wish to operate in because they vary from state to state,” says Calvin Frye, owner of genetics company Cloneville and member of Cannabis World Congress & Business Expo’s advisory board. 

2. Develop a solid business plan 

A roadmap is a must for any entrepreneur in any market, and cannabis is no exception. A business plan serves as your guide forward and is a must for defining your goals, identifying your target market, and developing strategies for financing and growth. The critical elements of a business plan typically include determining your mission statement, conducting market research, developing a marketing strategy, setting goals, and creating financial projections. 

Suppose that you are a cannabis cultivator looking to expand your business. A well-crafted business plan would involve determining your target market and your company’s purpose, values, and finances to ensure that expansion is feasible and sustainable in the long term. It can also serve as an important document to present to potential investors to help you raise the capital you need to launch your business. 

3. Network early and often 

It’s often said that “it’s not what you know, but who you know” that matters in the business world. Building relationships early and often can help you better understand the industry and gain new insights, especially in rapidly-evolving spaces like cannabis. Attending industry events like CWCBExpo, for example, can be a great way to meet other industry professionals and learn from their knowledge and experience. 

When networking, remember to be authentic, genuine, and respectful. Focus less on what you can get out of the relationship and instead look for ways you can add value and help others. And don’t forget to bring your business cards or create a digital card!

Other tips for networking success include asking questions and following up with the people you meet. It never hurts to send a quick email or LinkedIn message after the show to stay in touch and continue building your network. 

4. Build a strong team

Bringing quality talent into your business early is critical for success. With so much competition and so many regulatory hurdles to navigate, you’ll need a team that can help you execute your vision and stay ahead of the curve. When building a team, look for people who not only share your values but bring unique skills and perspectives to the table. For example, if you’re a cannabis retailer, you may want to seek out team members with experience in customer service or marketing. 

Look for people who are passionate about the cannabis industry and be sure to prioritize a positive and inclusive environment. Investing in training and development can also help your team develop and grow and build a culture of continuous learning and improvement. Also consider hiring professional services to support your company. Legal counsel is an absolute must, but financial, marketing, and HR professionals can also augment your team.

5. Embrace innovation 

The cannabis industry is constantly evolving, with new products, technologies, and regulatory changes shaping the landscape daily. As an entrepreneur in this space, finding strategies to stay ahead of the curve is essential. Embracing innovation can help you to differentiate your business from the competition, create new revenue streams, and better serve your customers. 

Think about virtual reality as an example. A cannabis retailer may explore the use of VR to create immersive in-store experiences and better showcase their product offering to customers. Manufacturers may work to refine consumer favorites or develop totally new types of cannabis products. Whether you’re a cultivator, retailer, or anything in between, staying open to new ideas and being willing to take risks will help position your business for long-term success. 

Challenges and opportunities in the cannabis industry 

Cannabis entrepreneurs face a unique set of challenges that can make it complicated to operate in this space. So as you begin your cannabis industry journey, be aware of the following:

  • Legal and regulatory challenges: Cannabis entrepreneurs face a complex and constantly evolving legal landscape, with different laws and regulations governing the plant at federal, state, and local levels. Navigating these challenges is one of the most important priorities for a cannabis entrepreneur.

  • Advertising and marketing restrictions: Cannabis businesses are often subject to strict advertising and marketing regulations, which can limit their ability to reach their target audience and build awareness. These restrictions include traditional and digital advertising limitations, from billboards to social media promotion.

  • Stigma and social acceptance: Despite growing acceptance and legalization of cannabis, there is still a significant amount of stigma associated with the industry. These barriers can limit public support for cannabis businesses and restrict access to certain services.

  • Limited access to traditional business resources: Due to the unique challenges faced by cannabis businesses, entrepreneurs may have limited access to conventional business resources such as banking, loans, networking opportunities, and mentorship programs. 

With great challenges, however, come great opportunities for growth and positive social change. Whether it’s through supporting medical research or advocating for legalization, entrepreneurs navigating the complex landscape of cannabis have the chance to make a difference in the lives of others. So while the challenges are significant, the potential rewards are even greater.

NYS Office of Cannabis Management (OCM) Update

On May 11 the Cannabis Control Board (CCB) held their meeting at SUNY Morrisville. At that meeting, the CCB:
  • Approved 50 more provisional CAURD licenses bringing the total to date to 215 across NYS
  • Approved another Lab Testing Facility bringing the total to 14 licensed labs in NYS
  • Presented the Social & Economic Equity (SEE) Plan
  • Presented Revised Adult-Use Regulations – a 45 day comment period is in effect so get your comments in

He signed a tax relief bill on May 8th that provided a work-around from the strangulating federal 280E tax regulations where cannabis business owners can’t write off the same business deductions that non-cannabis owners can write-off.

History Continues to be Made in NYC

Congratulations to Extasy James for making history, as she opened the very first retail dispensary in Queens – Good Grades – and for being the first woman-owned retail dispensary that is financially supported by the social equity investment fund. Queens Borough President Donovan Richards was there and made the first purchase.

NYS OCM Updates

April saw great progress and activity by the NYS Office of Cannabis Management (OCM). On April 3, the Cannabis Control Board approved 99 new conditional adult use retail dispensary licenses across New York State and New York City.

And on 4/20, the OCM opened up a Public Comment Period for Cannabis Research Regulations. There are 9 proposals set forth regarding Cannabis Research Regulations. Public comments must be submitted by 6/11/23.

We are looking forward to welcoming several members of the OCM to be on the show floor of CWCBExpo. The OCM will also be speaking in a series of seminars on Saturday, June 3, the last day of the CWCBExpo. The sessions will end with a CAURD Q & A session. So plan to stay and don’t miss a thing.

Check out this poll released on April 25th from Stockton University which highlights the responses of 660 New Jersey adult residents answering a variety of polling questions about dispensaries and consumption.

Congratulations to Delaware which became the 22nd state to join the other Adult-Use states on April 21. Two Bills were passed. Though Governor Carney is not a supporter of marijuana legalization, he did not veto them this time around.

The first adult-use dispensary to open in New York City now offers delivery. Customers can order online and request delivery to select areas throughout the city.

Staten Island, Bronx, Brooklyn Poised to Make Dispensary History

Staten Island has been approved to have adult-use recreational dispensaries. Staten Island will get 6 adult-use recreational dispensaries – 3 more than the 3 that were approved prior to the New York State (NYS) Office of Cannabis Management (OCM) doubling the Conditional Adult-Use Retail Dispensary license allocations across the state. In doubling the amount of licenses, the Bronx will get 20 and Brooklyn will have 38. Read more about the OCM doubling the licenses and these pioneering boroughs soon to make history.

Also exciting is that the first Staten Island recreational dispensary may be opened by Memorial Day weekend, just days before the CWCBExpo.

NYS OCM Update

Progress continued early this March when the NYS OCM announced three major decisions geared to move the NYS cannabis industry forward. The OCM:

  • Increased the number of conditional adult-user etail dispensary licenses to 300
  • Adopted regulations for packaging, labeling, marketing & advertising, and for laboratory testing
  • Approved regulations governing cannabis research for public comment

New Jersey Cannabis Regulatory Commission

Last month in our February Newsletter we highlighted the issue of NJ consumption lounges and the CRC’s proposed rules surrounding how consumption lounges may operate. The CRC’s proposed regulations on consumption lounges were open to public comment through March 18th.

The next CRC meeting is scheduled for April 13. Let’s see what develops.

Oklahoma did not become the 22nd state to join the other Adult-Use states. Oklahomans voted against legalizing Adult-Use marijuana in their state.

IN MEMORIAM: RAPHAEL MECHOULAM

Our industry mourns the passing of Raphael Mechoulam while it celebrates his life and dedication to cannabis science and research. Known as the “Father of Cannabis,” Dr. Mechoulam opened up the entire field of cannabinoids and their importance. He passed on March 9, 2023 at the age of 92.

Union Square Travel Agency opened its doors as an adult-use dispensary on February 13, 2023 in New York City.

Congratulations to Union Square Travel Agency, the third adult use dispensary to open in New York City. CWCBExpo was there to witness this milestone. Tremaine Wright, Chair of the New York State Office of Cannabis Management (OCM) was at the Ribbon Cutting ceremony as history was being made amidst a very happy and excited crowd.

New York State Regulatory News

More good news as New York State builds its cannabis industry. The OCM recently announced some major decisions. Between January and February, the OCM:

  • Awarded 30 Cannabis Adult Use Retail Dispensary (CAURD) Provisional Licenses increasing it to 66
  • Awarded 1 additional Conditional Processor License now making the total 40
  • Gave approvals for testing permits to 5 independent cannabis testing labs
  • Approved Medical Cannabis Regulations changes to make the patient registration experience easier
  • Appointed a General Counsel to the OCM

Congratulations to Suzan Nickelson, owner and CEO of Holistic Solutions, who opened her dispensary – the very first Black female-owned dispensary in New Jersey – on February 10, 2023. The dispensary is located in Waterford Township, NJ. Nickelson’s dispensary opening was featured in MarketWatch.

New Jersey Consumption Lounges

We highlighted in our January Newsletter that the New Jersey Cannabis Regulatory Commission (CRC) has proposed rules and amendments regarding consumption lounges. We do it again here.

There is still time to submit commentary on the issue of consumption lounges and the proposed rules by the CRC. The public commentary period expires on March 18, 2023. Now is the time to get your comments into the NJCRC.

More Exciting News About New Jersey and Consumption Lounges

Congratulations to Faye Coleman, Co-Founder & CEO of Pure Genesis. Coleman is developing a Cannabis Consumption Lounge, Endo, to be opened in Atlantic City on a site that was previously a church. The business plan for the consumption lounge includes an educational component that Coleman is creating with Stockton University as well as an employment plan to create jobs for the local community. Coleman also has the blessing from the pastor of the church that formerly occupied the site. A great start!

New Jersey Licensing & Regulatory News

This month the NJ Cannabis Regulatory Commission (CRC) has issued decisions and actions which add to the East Coast’s rapidly growing cannabis industry. The CRC’s actions address a variety of issues that help move the NJ cannabis industry forward, including:

  • Adopting new rules on how licenses are processed and prioritized, as well as new rules and guidelines on cannabis business classes
  • Removing the cap on cultivation licenses
  • Removing some of the limitations on certain vertically integrated businesses – this would allow cannabis license holders to hold a variety of licenses at the same time
  • Awarding a number of conditional, annual and condition-to-annual licenses

In a few weeks, Oklahoma could become the 22nd state to join the other Adult-Use states. On March 7, 2023 Oklahoma voters will vote on whether or not to legalize Adult-Use marijuana.

Texas Legalization News

Texas House Bill 1937 has been introduced by state Rep. Jessica González (D) of Dallas to allow counties and municipalities to legalize adult-use marijuana at the local level.

The Bill seeks to allow the Texas Commission of Licensing and Regulation to adopt all necessary rules for the administration and enforcement of the bill, including licensing, regulation, testing standards, and transportation.
