While business owners, investors, medical professionals, and activists look toward the prospect of rescheduling, it begs the question of how did cannabis become a Schedule I drug in the first place? It has been a Schedule I drug since 1970, when Congress enacted the Controlled Substances Act (CSA). With that, the modern war on drugs was born and it has continued to proliferate for decades since.

In 1969, NYC’s own former Mayor Ed Koch, at the time a US Representative, held a conference attempting to classify cannabis differently than what it is today. A broadcast from the archives of WNYC, “Tensions High at 1969 Conference on Marijuana” is quite informative and highlights the history of how cannabis landed on Schedule 1.

Licensing News from the NYS Office of Cannabis Management and Cannabis Control Board

In our May Newsletter, we highlighted the operational changes that governor Hochul started to make at the Office of Cannabis Management (OCM) since the final report from Jeanette Moy, the Commissioner of General Services. Significant changes and announcements in management at the OCM continued this June. NYS Governor Kathy Hochul appointed the following individuals into roles that she expects to help run the OCM more effectively and efficiently:

  • Felicia A. B. Reid has been appointed Executive Deputy Director and Acting Executive Director.
  • Susan Filburn has been appointed Chief Administrative Officer.
  • Jessica Woolford has been promoted to the position of Director of External Affairs.

NYS Retail Cannabis Taxation Rules

More action at the OCM pertains to the taxation of retail cannabis. The OCM has reformed the taxes associated with retail cannabis sales including:

  • Repealed the THC tax
  • Excise tax on medical cannabis has been reduced to 3.15%
  • Other taxes remain in effect such as the wholesale tax, the local tax, and the state tax

Illicit Shops Being Shut Down

NYS and NYC continue to see more legal dispensaries open up and more illicit shops shut down. By June 18, Governor Hochul’s appointed NYS Task Force closed down 114 illegal cannabis shops. This helps increase sales at legal dispensaries and builds a stable and legal cannabis industry throughout the state.

Recently, Slovenian voters gave their opinions about cannabis reform proposals that were non-binding and had no guarantee that they would become law. Rolling paper company seeks volunteers to smoke pre-rolls 

Cannabis rolling paper company DaySavers is seeking 200 volunteers aged 21 and older to participate in their “Science of Smokeability” study. Volunteers will receive $4.20 as a stipend to smoke two free pre-rolls (shipped at the company’s cost) and provide feedback on their experience. 

 

In partnership with the Cannabis Research Coalition and the Network of Applied Pharmacognosy (NAP), DaySavers aims to investigate how different cultivation and processing methods influence the quality and consistency of the smoking experience. Over a two-year period, researchers will analyze laboratory tests and consumer feedback to refine cultivation practices and overall smoke quality. 

 

“This research not only has the potential to improve product quality and consistency but also promote sustainability, profitability, and a deeper scientific understanding of cannabis as a medicinal and recreational product,” the company said in a press release.

 

Study finds older medical patients experience improvement in health and well-being 

A new study published in the journal Drugs and Aging highlighted promising findings regarding the therapeutic benefits of medical cannabis for older adults. The research indicates that cannabis products have the potential to significantly improve health, well-being, sleep, and mood among older patients – mainly related to pain severity and chronic pain. 

 

The study was conducted by a five-person research team and addressed what authors called “a common methodological practice of excluding those aged over 65 years from clinical trials.” Of the products prescribed during the study, patients over 64 were “more likely to receive CBD dominant oil and less likely to receive THC dominant flower by prescription.”

 

“International evidence that older individuals may be the fastest-growing increase in the use of medical marijuana, coupled with their frequent exclusion from controlled trials, indicates a growing need for real-world evidence to assess the effectiveness and safety of these drugs for older individuals,” reads the report. 

 

College enrollment increases in states with legal cannabis 

A recent study analyzing college enrollment trends in states that have legalized recreational cannabis reveals an impact on high education participation. According to the findings, the adoption of recreational cannabis laws increases college enrollments by approximately 9%, with no adverse effects on degree completion or graduation rates. 

 

The study also highlighted that legalization can enhance colleges’ competitiveness, attracting out-of-state students who perceive legal cannabis as a positive amenity. Researchers found no evidence that recreational cannabis laws affect college affordability, education quality, or enrollment rates for in-state students. 

 

“The results indicate that both women’s and men’s enrollments rose significantly after the fourth year of the first dispensary opening,” the report says, noting that the delay could be due to the time it takes for students to decide on and apply to college, as well as the often slow rollout of cannabis retail markets.

 

Cannabis beverage sales grow more slowly than edibles sales 

Cannabis beverage sales have grown more slowly than the total edibles category between Q1 2022 and Q1 2024, according to recent data from BDSA reported by Cannabis Business Times. In Q1 2024, cannabis beverage sales generated $50 million in total across BDSA-tracked markets (AZ, CA, CO, FL, IL, MA, MD, MI, MO, NV, NJ, NY, OH, OR, PA). That represents a 6% share of total edible sales, and a 1% share of total cannabis sales. Comparatively, in Q1 2023, beverage sales totaled $48M across those markets. BDSA forecasts that cannabis beverages will maintain approximately 1% of total cannabis sales across legal markets moving forward.

 

Cannabis gummies continue to dominate the edible market, consistently outpacing other types of edibles in consumer preferences. Three-quarters (75%) of medical and recreational edible consumers have enjoyed gummies in the past six months, while just 8% of the same group report drinking cannabis beverages or teas during the same period.

New York cannabis market tops $150M during first year of operations

The New York cannabis market has surged beyond expectations, reaching $150 million in sales during its inaugural year. A report by the New York Office of Cannabis Management (OCM) noted that while just 40 adult-use cannabis dispensaries have opened for business across the state, there were more than 6,900 cannabis industry applications received in 2023, including:

  • 538 cannabis processor applications,
  • 372 cultivation license applications,
  • 351 distributor license applications,
  • 1,349 microbusiness license applications, and
  • 4,324 retail dispensary applications.
  • Of the 6,934 total applications, 3,826 — about 55% — were equity applications, regulators said.

“New York Cannabis has momentum heading into 2024 and we’ll keep working to make this market grow. We have a lot of work to do, and we have much to be proud of; now that the core market architecture is in place, my team at OCM is ready to scale and help this industry thrive across New York State,” OCM Executive Director Chris Alexander said in a statement. 

New York governor proposes repealing cannabis potency tax 

Gov. Kathy Hochul (D) is calling for the elimination of the THC potency tax as a part of her executive budgets, aiming to reduce costs for consumers in a way that would make the regulated market more competitive against illicit operators. 

Hochul’s proposal replaces the potency tax with a wholesale excise tax of 9% in an attempt to “simplify, streamline, and reduce the tax collection obligations and burden for cultivators, processors, and distributors.” Cannabis would still be subject to the existing 9% state retail excise tax and 4% local retail excise tax, as well. 

The brief for the budget changes says the tax changes would “promote and support the expansion of the legal adult-use cannabis market” and also result in $6.5 million in tax revenue for localities. Hochul’s budget proposes $68.1 million in funding for the OCM in the next fiscal year.

New York officials will vote on home cultivation rules in February

New York regulators will vote on a set of proposed regulations for home grow for adult use. The proposal comes more than a year after adult-use sales began in the state. 

The proposal rules would allow adults to grow up to three mature and three immature cannabis plants in their home. The proposal includes a per household limit of six mature plants and six immature plants per private resident, regardless of the number of adults who live there. 

Other proposed rules include: 

  • Individuals can only cultivate at a single location
  • Landlords will not be able to prevent tenants from growing cannabis and will be able to determine whether to install other mitigation policies 
  • Those residing in federal or federally-subsidized housing will not be able to cultivate at home 
  • Home-grown cannabis cannot be shared or gifted 

If passed, adults would also be permitted to keep up to five pounds of cannabis at a time that they have obtained from the legal plants they grow. Currently, adults can possess up to three ounces of cannabis in New York, so this would represent a major increase in the amount of cannabis that is legal to possess.

If the Cannabis Control Board (CCB) approves the proposed rules, a 60-day public comment period would begin. If no significant changes are made based on that period, the OCM will submit the regulations for final approval. A revised proposal would be followed by a 45-day public comment period, so it would still be some months before the rules were implemented if approved.

New Jersey regulators finalize plans for cannabis lounges

Regulators in New Jersey have officially signed off on rules governing the operation of cannabis consumption lounges and are expected to review applications in the coming months. Under the plan, dispensary owners would be eligible to open no more than one lounge, with an associated fee of $1,000 for microbusiness and $5,000 for standard businesses. 

Patrons must be 21 years of age or older to purchase or use cannabis products on-site in these lounges. Notably, medical cannabis patients will be permitted to bring their own products. Sales of food and alcohol will be prohibited. However, customers may be able to bring their own food or order food for delivery, mirroring the rules for New Jersey breweries, wineries, and distilleries.

The edition spotlights a game-changing decision by New York’s Cannabis Control Board, as well as the flourishing market in New Jersey. MSOs approved to enter the New York adult use market

Following the state’s Supreme Court decision on December 1st to lift an injunction hindering the issuance of new Conditional Adult-Use Retail (CAURD) Licenses, the Cannabis Control Board (CCB) in New York has officially given the green light to multistate operators (MSOs) with medical marijuana licenses to enter the adult use market on December 29th, 2023. 

The decision comes exactly one year after the state launched recreational sales. Thus far, the CCB approved the following six organizations to join the adult use market: 

  • Columbia Care NY, whose parent is New York-based MSO The Cannabist Co.
  • Curaleaf NY, part of New York-headquartered MSO Curaleaf Holdings
  • Etain, owned by RIV Capital, a Toronto-based investment firm
  • NYCanna, part of New York-headquartered MSO Acreage Holdings
  • PharmaCann of New York, whose parent is Chicago-based MSO PharmaCann
  • Valley Agriceuticals, whose parent is Chicago-headquartered MSO Cresco Labs

While the waiting period had been adopted to provide a first-to-market advantage to social equity retailers and smaller supplies, gears have shifted in an effort to expand retail options as hundreds of unlicensed shops continue to plague the market. 

These six companies will eventually be permitted to set up co-located adult-use sales at up to three of their existing medical dispensaries. For the time being, however, each was approved for a single shop that can open by the end of the month. The CCB also approved new medical-only locations for both Citiva and Fiorello. 

New Jersey sales increase as prices drop 

New Jersey cannabis sales are stacking up high, as the recreational market recorded $206.1 million for Q3 2023. This brings the state’s total legal market revenue for the year to $762.9 million. The New Jersey Cannabis Regulatory Commission (CRC) reported a 10% increase in sales in the same quarter, from the $160.2 million in adult use cannabis revenue generated from April through June. 

According to CRC Executive Jeff Brown, consumers are attracted to the licensed marketplace, which includes 70-plus adult-use dispensaries statewide. As a result, prices for products are starting to come down. The average flower price dropped to roughly $354 per ounce at adult-use retail, representing a 10.5% decrease from January’s average price of $396. 

“New Jersey’s market continues to grow,” Brown said during the commission’s regular meeting on Dec. 7th. “For the first time in history, legal cannabis sales in New Jersey eclipsed $200 million in the third quarter of 2023. That includes just shy of $177 million of adult-use sales and just shy of $30 million of medicinal sales.”

New Jersey’s adult-use sales accounted for nearly 86% of all sales for the third quarter of 2023. The state’s medical market continues to shrink due to expanded opportunities for consumers.

More dispensaries are opening across New York 

Gov. Kathy Hochul (D-NY) has announced the opening of one dozen new adult-use dispensaries from Brooklyn to Buffalo. By the end of December 2023, the state anticipates having at least 37 adult-use dispensaries open for businesses. Among the opening locations, eight are majority Black-owned, five are Hispanic-owned, and nine are woman-owned.

“As New York expands the most equitable cannabis market in the nation, my administration remains committed to building a safe industry for all New Yorkers that will grow our small business community,” Governor Hochul said in a press release. “These new dispensaries continue our mission of strengthening our legal market while at the same time helping to push out the bad actors who skirt our laws and undermine all we are trying to accomplish.”

Senator pushes DEA to act on cannabis rescheduling 

 

In a recent letter, Sen. Kristen Gillibrand (D-NY) urged the Drug Enforcement Administration (DEA) to expedite the rescheduling of cannabis, a recommendation which was put forth by the U.S. Department of Health and Human Services (HHS) in August 2023. 

 

In the letter, which was addressed to DEA Administrator Anne Milgram, Gillibrand expressed her belief in the complete descheduling of cannabis and emphasized the immediate necessity of rescheduling cannabis from Schedule I to Schedule III under the Controlled Substances Act (CSA). 

 

“Marijuana is simply not comparable to other Schedule I substances like heroin, LSD, and MDMA. Moreover, marijuana enforcement has, for decades, disproportionately targeted communities of color,” Gillibrand stated in a press release. “This means that people of color are more likely to have criminal records for marijuana possession and to face needless barriers to employment, housing, and educational opportunities as a result. It is past time to end overly restrictive federal marijuana policy and I urge the DEA to do so immediately.”

Public support for cannabis legalization reaches an all-time high

 

According to a new Gallup poll, seven in 10 Americans support cannabis legalization, an all-time high since the Washington, DC-based analytics and advisory company began polling on the topic in 1969. 

 

In the first poll, conducted in 1969, only 12% of respondents supported cannabis reform. This year, 70 percent of U.S. adults say cannabis should be legal for adult consumption. It’s the first time support for legalization has increased since 2020, up from 68 percent in favor of legalization during the past three years of polling.

 

For the second year in a row, majority support for legalization was found among all demographics, including age, political party, and ideology. There were no notable differences in support by gender, race, or education. Only 29 percent of respondents said they think cannabis should not be legal, while one percent remain unsure. 

 

Democrats seek federal guidance for cannabis business owners with prior convictions 

 

A group of 20 Congressional Democrats have formally reached out to the Treasury Department urging a revision in guidance to alleviate constraints faced by cannabis business owners with prior convictions related to cannabis. 

 

Since 2014, the Financial Crimes Enforcement Network (FinCEN) has directed financial institutions to consider various “red flags” before extending services to cannabis-related businesses. This includes all past cannabis criminal records and involvement in the illegal purchase or sale of cannabis, regardless of whether the act is now considered legal at the state level. Consequently, banks can view business owner’s convictions for simple cannabis possession as a reason not to provide financial services such as banking services or business loans, even in states where cannabis is now legal. 

 

The group of lawmakers — led by U.S. Sens. Elizabeth Warren (D-Mass.), Jeff Merkley (D-Ore.), Raphael Warnock (D-Ga.) and U.S. Representative Earl Blumenauer (D-Ore.) — conveyed their concerns in a letter addressed to Treasury Secretary Janet Yellen and FinCEN Director Andrea Gacki underscoring the current guidance as “outdated.” 

 

“The updated guidance should clarify that if a marijuana-related act has been expunged, pardoned, is no longer illegal under state law, or is not disqualifying for obtaining a state marijuana license or permit … then financial institutions should not consider that offense a ‘red flag’ when conducting customer due diligence of marijuana businesses,” the lawmakers said in the letter.

 

USDA may revoke hemp licenses for cannabis farmers 

 

The U.S. Department of Agriculture (USDA) is taking a firm stance on hemp cultivation, reportedly revoking licenses for farmers engaged in the simultaneous cultivation of cannabis within state-approved programs. 

 

Hemp cultivation was legalized in the 2018 Farm Bill, which enabled farmers across the country to begin producing hemp plants, defined as cannabis that contains 0.3% THC content or less. Since, some farmers in states where cannabis is legal have also begun cultivating marijuana containing higher levels of THC, something the USDA apparently wants to put a stop to. It’s unclear how many farmers have been contacted by USDA, however, the decision could have significant implications for farmers navigating the cultivation landscape. 

 

Vermont-based farmer Sam Bellavance told Seven Days that he received an email from a USDA official months after he began growing marijuana under his state’s program. According to Bellavance, the email notes, “regulations don’t allow for a hemp-licensee to also be producing marijuana, even if licensed to do so by a state program,” and went on to tell Bellavance he would need to surrender either his federal hemp license or his state recreational cannabis license.

 

With changes causing serious issues for cultivators, lawmakers, and industry stakeholders are considering potential changes to the next large-scale agriculture legislation to better serve hemp farmers. This includes proposals to free up hemp businesses to legally market products like CBD as dietary supplements and to remove industry restrictions on people with certain prior drug convictions.

Lawmakers reintroduce bipartisan legislation for federal Legalization 

U.S. Democratic and Republican lawmakers have reintroduced a bill to set the basis for the federal legalization of adult-use cannabis. The bill called the “Preparing Regulators Effectively for a Post-Prohibition Adult Use Regulated Environment (PREPARE) Act,” was reintroduced last week by Congressman Dave Joyce (OH-14) and House Minority Leader Hakeem Jeffries (NY-8). 

The PREPARE Act aims to foster collaboration among a wide range of experts in the pursuit of cannabis reform. It works toward the establishment of a federal regulatory system and strives to lay the groundwork for a more effective, informed, and inclusive approach to cannabis policy. 

“The PREPARE Act is one of the bipartisan solutions that will lay the groundwork to finally right these wrongs in a way that advances public safety and boosts our economy,” said Jeffries in a press statement.

U.S. lawmakers have attempted to pass legislation affecting segments of the cannabis industry in the past through legislation like the MORE Act and the SAFE Banking Act. However, there has been no luck so far passing a bill on a national level that affects the cannabis industry. 

Senate holds first hearing on the SAFE Banking Act 

The Senate banking committee held its first-ever hearing on May 11th regarding a bipartisan bill that would formally codify banking best practices for the cannabis industry.

The meeting, coined “Examining Cannabis Banking Challenges of Small Businesses and Workers,” featured testimony from lawmakers on both sides of the political spectrum, including Sens. Jeff Merkley (D-OR) and Steve Daines (R-MT). Representatives from organizations such as the Cannabis Regulatory of Color Coalition, Drug Policy Alliance, and the United Food and Commercial Workers International Union presented their perspectives. 

“The cannabis landscape looks far different than it did a few short years ago,” Banking Committee Chairman Sherrod Brown (D-OH) said in a statement. “Cannabis has been legalized or decriminalized in almost every state. States and localities have established licensing and social equity programs to ensure that small businesses and communities impacted by the War on Drugs are part of the growing legal cannabis industry.”

While the bill has seen significant attention over the last few years with support from Sen. Elizabeth Warren (D-MA) and Senate Majority Leader Chuck Schumer (D-NY), it’s still in the early stages of the legislative process. In order to become a law, it would need to pass the Senate and House before reaching the President’s desk for final approval. 

U.S. Department of Transportation finalizes cannabis testing policies

The U.S. Department of Transportation (DOT) amended its drug testing policy, in a move that carries potential implications for commercial drivers, truckers, pilots, and other equipment operators who consume cannabis outside of work.

Published in the Federal Register on May 2nd, the notice explains that oral saliva testing for THC is now permitted. Prior to this rule change, urine-based tests were required. 

Because THC can show up in drug screenings for weeks or months after consumption, urine tests have received backlash among workers and advocates who say these tests are ineffective and can infringe on privacy. These affected workers could be sober on the job, but may show up as positive for THC anyway. Oral saliva testing aims to adapt drug testing methods to better align with the evolving landscape of cannabis use, as THC is detectable in saliva for up to 72 hours after consumption. 

“Allowing employers to use oral fluid testing may improve the effectiveness of drug testing,” the DOT stated. “Oral fluid testing can detect the recent use of some drugs, including marijuana and cocaine, while urine drug testing has a longer window of detection.”
