Rescheduling News

Rescheduling Decision Delayed

DEA Hearing Delayed Until 2025

The Drug Enforcement Administration (DEA) just announced (on November 1), that the scheduled December 2 hearing, with testimony and witnesses, will be delayed into 2025.

Before this delay, the DEA had just begun to notify the selected participants who would speak at the December 2 hearing. The purpose of this hearing was for the DEA to gather more information from stakeholders and experts on the issue of rescheduling cannabis from a Schedule I to a Schedule III drug. Applicants submitted a letter requesting to speak at the hearing.

New York State Cannabis News

New York State Office of Cannabis Management, Cannabis Control Board

Noteworthy happenings have transpired this month regarding New York State and its efforts to strengthen and expand the build-out of its cannabis industry efforts. Among them include:

The Cannabis Control Board (CCB) held a meeting on October 17, 2024. At the meeting they reported that the total Cannabis Retail Sales amount is close to reaching $700 million. Other valuable stats were reported about NYS cannabis sales, dispensaries, licensing, etc.. The public comment period ended on October 28, 2024 regarding the proposed amendments to marketing and advertising cannabis and cannabis products in NYS. Proposed amendments were filed by the NYS CCB to the Department of State to Parts 128 & 129 Packaging, Labeling, Marketing and Advertising Regulations. NYS opened up the application process for Adult-Use Processor Type-3 Branding licenses. Though not a plant-touching license, it allows the licensee to enter into white labeling agreements with NYS licensed cannabis processors who will manufacture a brand’s cannabis products. NYS launched a grant application program called the Community Reinvestment Program. This program aims to fund non-profit organizations dedicated to supporting young people in under-served and under-resourced communities. This program will be funded by legal adult-use cannabis sales in line with the Marijuana Regulation and Taxation Act (MRTA) which legalized Adult-Use cannabis sales in NYS. Since MRTA was introduced in 2021, much has occurred in NYS and its efforts to build its legal cannabis industry. New Jersey Cannabis Regulatory Commission Issues Announcements

Much has happened in New Jersey. The New Jersey Cannabis Regulatory Commission (NJCRC ) has made progress in many areas. Here are several of their many recent announcements:

The NJCRC held its final virtual session to seek input from stakeholders of medicinal cannabis on October 1, 2024. They sought participation from healthcare providers, patients, and business owners. These meetings were focused on Product Safety, Packaging, and Labeling Committee (PSPLC), and Permitting and Licensing Committee (P&LC).
The Cannabis Training Academy opened on October 16, 2024
The final Medicinal Cannabis Program (MCP) Registration Clinics are set for November 13, 15 and 19, 2024
As of October 22, 2024, there are 2,108 approved Recreational Licenses
As of October 17, 2024, 170 retail and medical dispensaries have opened across 21 counties in NJ

Military Veteran Opens New Jersey Dispensary

Congratulations to Dr. Alyza Brevard-Rodriguez, CEO & Founder of the recently opened adult-use dispensary “The Other Side,” located at 36 Congress Street in Jersey City.

Dr. Alyza spoke in our June 2024 CWCBExpo conference in the Dispensary Workshop and at the Women’s Entrepreneur Luncheon. She earned her doctorate in Leadership Management, and is a twice disabled combat veteran and a former U.S. Navy military police officer. She is also an industry trailblazer being the first Black, LatinX, LGBTQ, Female, and Disabled Veteran licensed cannabis operator in NJ.

Did you know that Uruguay was the first country in the modern era to legalize recreational cannabis? The year was 2013 under president Jose Mujica. He did it to combat drug crimes and to improve health. The legislation was monumental as it allowed ultimately for home grow.

Interview with Renata Serban, CPA (& more!)

The Fall season is just starting, students are back at school, and businesses are shoring up their planning.

In this Newsletter we feature Renata Serban, with a brief follow-up conversation from her podcast earlier this week.*

Renata Serban, a Certified Public Accountant and Certified Management Accountant is an award-winning cannabis accountant and Founder/CEO of Highly Elevated CPA. Renata has a wide-ranging background in many disciplines, including chemical engineering and finance, making her eminently qualified to advise cannabis entrepreneurs and guide their businesses forward.

Q: CWCBExpo – You moderated a session at our conference in New York this past June.* It was about how technology can impact a cannabis business. You have a technical background which made you the perfect moderator for the session, “High Tech: How Technology Can Drive Your Business.” You hold an engineering degree, you are a CPA, and you founded your own firm – Highly Elevated CPA – where you are an advisor, CPA tax specialist, and compliance expert to cannabis business owners.

With such a background and experience, when you advise new and existing entrepreneurs, how do you recommend they plan their finances for profitability, growth, and compliance while capital may be scarce?

A: Renata – My overall recommendation, and many business people will agree with me, is that before you start a business you need a business plan. For some reason, many start-up cannabis operators are ignoring it.

During the process of development of the business plan an entrepreneur will identify and analyze many aspects of business operations. For example, if it’s cultivation, what is the size of the lot or area where the plants will be grown, how many harvests will be during a year, what is the selling price per pound, how many employees are needed, what is the cost of build out, what are the other costs needed for getting the product ready for sale, who are the competitors, who are the potential partners?

When going through all of these thoughts an entrepreneur can have a much better idea how much funding is needed, what compliance is necessary since a business plan has to be tailored to cannabis regulations, and estimate potential growth by predicting how the market will move with time.

Scarce capital is always an issue not just for cannabis operators but for many other industries. Yes, there are more loans available for non-cannabis industries but many banks prefer operational businesses and very often the start-up non-cannabis businesses also struggle with capital raise.

Having a solid business plan with detailed financial projections is a must for any capital raise. Strong consideration also has to be given to strategic partnerships with other businesses.

“My overall recommendation is that before you start a business you need a business plan. For some reason many start-up cannabis operators are ignoring it.”

Once the company becomes operational, the profitability, growth and compliance is really driven by staying on top of the operations. I’m frequently seeing that some business owners in their first months of operations are over-hiring and over-ordering products. I always recommend starting lean with a smaller team and then gradually grow as needed. The same with products, start with small inventory, see how it goes and then increase purchases as needed.

All processes within the business need to be clearly identified so everyone knows their own responsibilities and has tools to perform those responsibilities. Automating as much of business operations as possible is important for efficient operations.

The marketing and advertising regulations in cannabis are a serious issue to consider when developing brand awareness and attracting foot traffic to the store. Dispensary owners need to think about brand development before the store is open, and they must constantly stay on top of their branding strategy once operations begin.

Prioritizing cash flow management, focusing on customer retention, efficient operations and reviewing financial metrics on a regular basis (at least monthly) are really the keys to growth.

Q: CWCBExpo – You have great experience with one of the largest CPA firms that serve the industry, and you now own your own firm, Highly Elevated CPA. What advice can you give to anyone looking to go out on their own after working for a large corporate company? What steps do you recommend for them to take prior to branching out on their own?

A: Renata – The profession of accounting is currently evolving. There is a shortage of qualified accountants which is due to many factors. Some of them are declined enrollment in accounting programs, high educational requirements along with the complicated CPA exam, stress due to complex compliance rules and long hours during the busy season.

My professional accounting background is very diverse and unique. Back in the day, many CPAs working for public accounting firms would eventually move to private accounting where they would work on accounting just for one company. Nowadays, the trend is in the opposite direction. Many public accounting firms prefer to hire accountants from the private sector since these professionals would most likely know not just accounting, but operations as well. This type of work experience is very useful in public accounting firms which makes them great advisors. This was my path decades ago. I moved from being a controller for a realty management firm to being an accountant at a CPA firm.

The size of the CPA firm is also very important and I was fortunate enough to work for small firms, mid-size and larger accounting firms. The experience was very different at each firm due to the size. At each firm I learned a lot.

Starting your own business is a very challenging and a risky task. Having good technical skills is not enough when branching out on your own. As a business owner you also have to understand that you need to bring new clients. So the main recommendation before you decide to branch out is to have a good business network and have your name out there. There are many super smart accountants that don’t know how to do business development.

It’s also important to identify the goals for your firm, who will be the ideal client for the firm, what services should be provided, how many clients are enough, the infrastructure of the firm, etc.**

Rescheduling

Rescheduling Update – Prior 280-E Debts Will be Enforced

In our August newsletter, we highlighted that the Drug Enforcement Administration has delayed Rescheduling cannabis from Schedule I to Schedule III and has set a hearing for December 2, 2024. The stated reason for the delay is that they need to gather more information before a decision is made. Luke Ortner, Senior Counsel, IRS, Office of Chief Counsel, appeared as a keynote speaker in the American Institute of CPAs® and the Chartered Institute of Management Accountants® Cannabis Conference. The senior Counsel was questioned and commented on a variety of issues surrounding the taxation impact on rescheduling. One point made was that the 280-E tax policy will continue to be enforced until rescheduling is completed, and any eventual removal of 280-E is not likely to be retroactive, meaning that any past due IRS debts regarding 280-E are likely to remain collectable liabilities.

New York State Office of Cannabis Management, Cannabis Control Board

This month the NYS Office of Cannabis Management (OCM) announced and issued for use a new tool called the Legal Online Cannabis Activities Locator (LOCAL) Map. It is geared to streamline the licensing process and allow for transparency. It also is trying to save applicants money by not having to engage third party services during the application process. In their announcement, the OCM highlighted several aspects of this LOCAL Map tool including that it helps applicants and businesses to:

Evaluate retail locations
Check municipal opt-out statutes
Access data for cannabis licensing in NYS

The LOCAL Map tool has both an Industry-Focused Map tool and a Consumer-Focused Map tool geared as follows:

The Industry-Focused Map tool is meant for applicants, licensees and stakeholders, and can provide proximity reports, search licenses and provide the data needed to meet regulatory requirements
The Consumer-Focused Map tool is a dispensary locator map that locates the nearest legal dispensary in New York

NYS Market Update

There is some very positive news about retail sales in NYS. The NYS Cannabis Advisory Board (CAB) held a meeting on September 24th, and John Kagia, the NYS OCM Director of Policy, provided some sales data on the NYS retail market. Kagia asserted that the revenue outlook by year’s end is quite good and could approach $800MM.

The total retail sales in August closed in on $100MM
The total retail sales is projected to be over $500MM by the third quarter

Much of the good sales news was helped by the opening of more licensed dispensaries combined with the crack down on illegal shops, which substantially helped the legal dispensary sales.

New Jersey Seeking Stakeholder Input on Medical Cannabis

Coming up on October, 1, the New Jersey Cannabis Regulatory Commission will have its final virtual session to seek input from stakeholders of medicinal cannabis. New Jersey Governor Phil Murphy Signs Hemp Bill

Governor Phil Murphy signed a bill that regulates the hemp market for intoxicating hemp products and prohibits the unauthorized sale to anyone under the age of 21.

DOOBIE Act

This month, the Senate Homeland Security and Government Affairs Committee approved the DOOBIE Act: Dismantling Outdated Obstacles and Barriers to Individual Employment. The DOOBIE Act is important because it limits the ability for federal agencies to use past cannabis usage against applicants getting security clearance or getting federal employment. This will certainly help to minimize the discrimination that applicants who use cannabis get when applying for federal jobs that require security clearances. Those applicants can no longer be disqualified solely due to prior cannabis use.

Nixon Recordings

The War on Drugs that Nixon unleashed needlessly created decades of injustice to people of the United States. Recently, it was uncovered that Nixon recorded, in his own words, his acknowledgment that marijuana is not dangerous. This revelation was recently found in his recordings that he kept private.

In our February Newsletter we highlighted that Germany legalized limited recreational use. Their plan sought to make it accessible through regulated cannabis non-profit groups with stringent rules regarding possession, age requirements, and grow restrictions among the members. Rescheduling Decision Delayed

The Drug Enforcement Administration (DEA) has delayed Rescheduling cannabis from Schedule I to Schedule III and has set a hearing for December 2, 2024. As we reported in our July Newsletter, the public comment period terminated with the DEA receiving over 40,000 comments. Now, Administrator Anne Milgram set a hearing to gather even more input before a decision is made. Who is going to attend this hearing? New York State Governor Kathy Hochul Announces Shutdown of Over 1,000 Illicit Shops

Governor Kathy Hochul is keeping her commitment to shutting down illicit cannabis shops across New York. Heading into August, Governor Hochul reported that she and NYC Mayor Adams successfully shuttered more than 1,000 illicit shops statewide. This action has helped increase sales for the legal shops. Seizures of illegal products are estimated to have been worth over $63MM.

New Jersey Seeking Stakeholder Input on Medical Cannabis

This September and October, the New jersey Cannabis Regulatory Commission will host scheduled virtual sessions that seek input from stakeholders of medicinal cannabis, including healthcare providers, patients, and business owners.

There will be four such virtual meetings. The meetings will be roundtables led by the Product Safety, Packaging & Labeling Committee, the Permitting & Licensing Committee, and the Public Engagement & Education Committee.

Stakeholders are invited to share feedback with the Board on key issues related to regulation, patient access, and institutional care in New Jersey.

The meetings are scheduled 11:30 am to 12:30 pm on each of the following dates:

September 5
September 23
September 25
October 1

On August 6th, Ohio started its Adult Sales and right out of the starting gate, sales were hot. In its first week it passed $11.5MM and continued its successful climb since. Combined medical and Adult Use is expected to be a billion dollar market.

Medical Cannabis Available

As of August 16th, medical cannabis was made available in Ukraine to veterans with post traumatic stress disorder and patients with serious illnesses. We reported in previous newsletters that President Zelensky signed into law a bill legalizing medical cannabis on February 15, 2024. Distribution of medical cannabis will be controlled by the government. Patients with a prescription from a doctor for qualifying conditions can now buy the drug legally.

What is the Drug Enforcement Agency (DEA) going to do now?

In our May and June newsletters we noted that the DEA was accepting public comments on rescheduling cannabis from Schedule I to Schedule III. The public comment period is now over. The DEA has over 40,000 comments to sift through. What will the DEA do? What is a likely outcome? And will the impending election have any impact if the DEA does not have a decision or has not taken action prior to the election?

According to the latest HEADSET analysis, 94% of respondents favored rescheduling or descheduling cannabis.

Issuing more licenses across several categories bringing the total for 2024 to 730

At the meeting, the CCB asserted that the cannabis industry in NYS is thriving and growing and that cannabis sales in 2024 will reach $200MM by this June. They said that to date, NYS cannabis sales have surpassed $420MM.

New Ballot Measures

Cannabis advocates in several states organized and gathered signatures to get legalization measures on their 2024 state ballots. The advocates in three states, Arkansas, Nebraska and North Dakota, had more than enough signatures to get the respective measures on the ballots. Arkansas and Nebraska seek medical ballot measures while the North Dakota ballot measure supports adult-use legalization.

Transitioning Dispensaries from Medical to Adult Use

Delaware Governor John Carney signed a legislative bill that allows a pathway for medical licensees and dispensaries to transition to adult-use operators. That pathway has fees to transition. The bill is meant to catapult the development of the adult-use cannabis market.

South Africa Works to Build its Cannabis and Hemp Sectors

In November of 2023, CWCBExpo editors visited the South African Consulate in New York City to discuss developing a cannabis industry. CWCBExpo has been following that country’s cannabis progress since our visit. Here are the latest developments.

South Africa has embarked on several priorities for their country’s Investment Strategy that will spur job creation and growth, and foster recognition of people’s rights.

This past spring, South African President Ramaphosa took significant action regarding the Cannabis and Hemp sectors. In May, President Ramaphosa signed a law called the Cannabis for Private Purposes Act (CfPPA) which regulates the cultivation, possession and use of cannabis by adults in private settings. It also removed cannabis from their Drugs and Drug Trafficking Act. The President’s action opens up the medical market even further for the medicinal cannabis and for further regulatory opportunity for cannabis use among adults.

President Ramaphosa’s actions continued in June when he took the results of a Phakisa that explored the Cannabis and Hemp sectors. A “Phakisa” is a targeted program that seeks to fast-track the government’s targets and goals that help business, education, society and government. The Phakisa for cannabis and hemp brought stakeholders together from several groups. The goal was to develop a cohesive plan to define policy and get various sectors of the South African government to work together to build a meaningful regulatory program for the cannabis and hemp sectors.

While business owners, investors, medical professionals, and activists look toward the prospect of rescheduling, it begs the question of how did cannabis become a Schedule I drug in the first place? It has been a Schedule I drug since 1970, when Congress enacted the Controlled Substances Act (CSA). With that, the modern war on drugs was born and it has continued to proliferate for decades since.

In 1969, NYC’s own former Mayor Ed Koch, at the time a US Representative, held a conference attempting to classify cannabis differently than what it is today. A broadcast from the archives of WNYC, “Tensions High at 1969 Conference on Marijuana” is quite informative and highlights the history of how cannabis landed on Schedule 1.

Licensing News from the NYS Office of Cannabis Management and Cannabis Control Board

In our May Newsletter, we highlighted the operational changes that governor Hochul started to make at the Office of Cannabis Management (OCM) since the final report from Jeanette Moy, the Commissioner of General Services. Significant changes and announcements in management at the OCM continued this June. NYS Governor Kathy Hochul appointed the following individuals into roles that she expects to help run the OCM more effectively and efficiently:

Felicia A. B. Reid has been appointed Executive Deputy Director and Acting Executive Director.
Susan Filburn has been appointed Chief Administrative Officer.
Jessica Woolford has been promoted to the position of Director of External Affairs.

NYS Retail Cannabis Taxation Rules

More action at the OCM pertains to the taxation of retail cannabis. The OCM has reformed the taxes associated with retail cannabis sales including:

Repealed the THC tax
Excise tax on medical cannabis has been reduced to 3.15%
Other taxes remain in effect such as the wholesale tax, the local tax, and the state tax

Illicit Shops Being Shut Down

NYS and NYC continue to see more legal dispensaries open up and more illicit shops shut down. By June 18, Governor Hochul’s appointed NYS Task Force closed down 114 illegal cannabis shops. This helps increase sales at legal dispensaries and builds a stable and legal cannabis industry throughout the state.

Cannabis License Application Period Opens July 1

Applications to get a license for medical cannabis businesses begins July 1, 2024. Applications can be submitted via the Kentucky state government portal. Several medical license types will be awarded including, Cultivator, Processor, Safety Compliance Facility, and Dispensary.

Ohio Approves First Adult-use Dispensary Licenses

Ohio became the 24th state to legalize the adult-use of cannabis on November 7, 2023. This June, Ohio has approved the first licenses for adult-use dispensaries. They issued 62 provisional licenses and 31 dispensary licenses across Ohio.

Ohio Now Taking Applications for Dispensary Licenses

On June 7, Ohio opened its window to apply for a recreational dispensary license. Medical dispensaries in Ohio are also eligible to apply to sell recreational cannabis is to adults 21 or older, effectively a dual-license.

Pennsylvania Introduces Cannabis Legalization Bill

Pennsylvania wants to join the cannabis industry and also pursue expungement for prior cannabis convictions with a newly proposed legalization bill.

Maryland Issues Pardons for Misdemeanor Cannabis Offenses

Maryland is among the 24 states that have legalized adult-use cannabis. Maryland Governor Wes Moore issued 175,000 pardons for misdemeanor related cannabis offenses on Monday June 17, 2024. This is a giant step toward trying to help those who have been harmed by the war on drugs. As this action by Governor Moore is welcomed, the damage may never be undone for most, even with a pardon.

Delaware Expands Its Medical Cannabis Program

Delaware expanded its medical cannabis program to allow physicians to make medical cannabis accessible a wider range of patients who may benefit from it. In addition, Delaware allows registered patients who are from other states to access Delaware dispensaries.

“Coffee Shops” to Try Quality Regulated Marijuana

The Netherlands is conducting an interesting experiment with the goal of providing options for “coffee shops” in the Netherlands to buy quality weed within a regulated network of growers. This would make both quality and quantity accessible to the “coffee shops” without relying on illegal weed. The regulated program launched in late 2023 and is expanding from two cities to ten cities and 80 “coffee shops” across the Netherlands.

Slovenia Cannabis News

Slovenian Citizens are in Favor of Cannabis Reform

Recently, Slovenian voters gave their opinions about cannabis reform proposals that were non-binding and had no guarantee that they would become law. The two measures that were “voted” on included opinions on home grow for medical patients, and home grow of cannabis plants for personal use. In both instances, the support was over 50% for each.

Rolling paper company seeks volunteers to smoke pre-rolls

Cannabis rolling paper company DaySavers is seeking 200 volunteers aged 21 and older to participate in their “Science of Smokeability” study. Volunteers will receive $4.20 as a stipend to smoke two free pre-rolls (shipped at the company’s cost) and provide feedback on their experience.

In partnership with the Cannabis Research Coalition and the Network of Applied Pharmacognosy (NAP), DaySavers aims to investigate how different cultivation and processing methods influence the quality and consistency of the smoking experience. Over a two-year period, researchers will analyze laboratory tests and consumer feedback to refine cultivation practices and overall smoke quality.

“This research not only has the potential to improve product quality and consistency but also promote sustainability, profitability, and a deeper scientific understanding of cannabis as a medicinal and recreational product,” the company said in a press release.

Study finds older medical patients experience improvement in health and well-being

A new study published in the journal Drugs and Aging highlighted promising findings regarding the therapeutic benefits of medical cannabis for older adults. The research indicates that cannabis products have the potential to significantly improve health, well-being, sleep, and mood among older patients – mainly related to pain severity and chronic pain.

The study was conducted by a five-person research team and addressed what authors called “a common methodological practice of excluding those aged over 65 years from clinical trials.” Of the products prescribed during the study, patients over 64 were “more likely to receive CBD dominant oil and less likely to receive THC dominant flower by prescription.”

“International evidence that older individuals may be the fastest-growing increase in the use of medical marijuana, coupled with their frequent exclusion from controlled trials, indicates a growing need for real-world evidence to assess the effectiveness and safety of these drugs for older individuals,” reads the report.

College enrollment increases in states with legal cannabis

A recent study analyzing college enrollment trends in states that have legalized recreational cannabis reveals an impact on high education participation. According to the findings, the adoption of recreational cannabis laws increases college enrollments by approximately 9%, with no adverse effects on degree completion or graduation rates.

The study also highlighted that legalization can enhance colleges’ competitiveness, attracting out-of-state students who perceive legal cannabis as a positive amenity. Researchers found no evidence that recreational cannabis laws affect college affordability, education quality, or enrollment rates for in-state students.

“The results indicate that both women’s and men’s enrollments rose significantly after the fourth year of the first dispensary opening,” the report says, noting that the delay could be due to the time it takes for students to decide on and apply to college, as well as the often slow rollout of cannabis retail markets.

Cannabis beverage sales grow more slowly than edibles sales

Cannabis beverage sales have grown more slowly than the total edibles category between Q1 2022 and Q1 2024, according to recent data from BDSA reported by Cannabis Business Times. In Q1 2024, cannabis beverage sales generated $50 million in total across BDSA-tracked markets (AZ, CA, CO, FL, IL, MA, MD, MI, MO, NV, NJ, NY, OH, OR, PA). That represents a 6% share of total edible sales, and a 1% share of total cannabis sales. Comparatively, in Q1 2023, beverage sales totaled $48M across those markets. BDSA forecasts that cannabis beverages will maintain approximately 1% of total cannabis sales across legal markets moving forward.

Cannabis gummies continue to dominate the edible market, consistently outpacing other types of edibles in consumer preferences. Three-quarters (75%) of medical and recreational edible consumers have enjoyed gummies in the past six months, while just 8% of the same group report drinking cannabis beverages or teas during the same period.

June 2024 was a dynamic month for cannabis news across the Northeast. From big strides toward potential adult use legalization in Pennsylvania to a key expansion of New York’s adult use market, this month’s update underscores the transformative potential of legalization not only economically, but also in fostering safety, equity and innovation. We’re also looking back at another great year for CWCBExpo and thanking everyone who joined us earlier this month. Let’s dive in!

CWCBExpo 2024 was a resounding success

CWCBExpo kicked off with a bang on June 4, featuring pre-show events and workshops on topics like dispensaries, cultivation, and more. The expo floor, open from 10 am to 5 pm over two days, showcased a range of exhibits presenting the industry’s latest products, services, and technologies. The programming offered informative sessions on everything from regulatory updates to investment strategies and market trends.

Notable highlights included Glenna’s Cannabis Creations, Let Mom Sleep, and HappySap CBD-infused Vermont maple syrup. Dispensaries like The Other Side Cannabis from Jersey City represented the local area, while companies like GrowPros Solutions and TrufflyMade showed off their products and services.

This year’s expo guest of honor was Josh Kesselman, founder and CEO of HBI International, known for the popular RAW Rolling Papers.

“The CWCBExpo was RAWesome! I was honored to give the keynote in my birthplace of New York City, which I consider the birthplace of RAW. I believe that New York is the epicenter of cannabis,” Kesselman shared with Cannabis Now. “Which is why it was so important to me that I speak with our entrepreneurial market makers and do my best to help guide them through this transitional period, towards a New York cannabis market that provides opportunities to all of us. We all get higher together, especially when you have a New York State of mind!”

PA lawmakers preparing recreational cannabis bill

In Harrisburg, PA, lawmakers are gearing up to introduce a new bill aimed at legalizing cannabis for adult use in Pennsylvania. The proposed legislation seeks to eliminate the illicit market, foster the growth of small businesses, and provide avenues for expunging certain cannabis-related convictions.

Additionally, it:

Establishes robust guidelines for the labeling, packaging, and advertising of products to ensure that products are not marketed to children and adolescents;
Implements a “clean slate” policy and criminal justice reforms for residents with cannabis-related convictions;
Provides funding and support for law enforcement to enforce cannabis regulations;
Provides funding for local municipalities with cannabis businesses;
Leverages our agricultural infrastructure and supports local farmers;
Generates new revenue for the state and creates jobs.

“I think it’s well past time for us to legalize cannabis,” said State Representative Emily Kinkead, a Democrat representing Allegheny County and prime sponsor of the soon-to-be-introduced bill. “The governor has estimated that it would bring about $500 million within five years,” she said. “I think that’s actually a pretty conservative estimate.”

Gov. Kathy Hochul announces more adult-use licenses

New York Gov. Kathy Hochul (D) unveiled an expansion of New York’s adult-use cannabis sector at the latest Cannabis Control Board (CCB) meeting. The board approved 105 adult-use cannabis licenses across all factions of the industry, setting the stage for increased economic activity and innovation within the market. The breakdown of the 105 license types approved includes:

25 Adult-Use Cultivator Licenses
22 Adult-Use Distributor Licenses
22 Adult-Use Microbusiness Licenses
19 Adult-Use Processor Licenses
17 Adult-Use Retail Dispensary Licenses

The CCB also approved a resolution to adopt the following regulations for home-grow:

Adults can grow up to six plants individually.
Maximum of 12 plants per household.
Registered medical cannabis patients can have a designated caregiver grow on their behalf, provided no one can exceed the maximum of 12 plants per household.

“New York is building a robust and equitable legal market that is driving significant economic growth within our communities,” Governor Hochul said in a statement. “The issuance of 105 additional adult-use licenses is just the next step in developing the nation-leading industry New Yorkers expect and deserve.”

PA could see up to $2.8 billion in adult-use sales in first year

According to Marijuana Moment, reports indicate that PA could experience a substantial economic benefit from legalizing adult-use cannabis, with projected sales ranging from $1.7 billion to $2.8 billion in the first year alone. Collaboratively produced by advocacy group Responsible PA and FTI Consulting, the analysis forecasts potential tax revenues of up to $720 million through a combination of retail sales and excise taxes. Moreover, legalization could generate between 26,250 and 44,500 new jobs, drawing comparisons from other states and insights from PA’s existing medical market.

“Nearly two-thirds of the jobs supported by the adult-use market would be direct cannabis jobs, with the remaining third supported indirectly or through induced spending,” states the report.

Federal Rescheduling

While not the ideal designation the industry wants, May was all lit up with news of rescheduling cannabis from a Schedule I drug to a Schedule III drug. More needs to be done, such as completely descheduling cannabis.

A public comment period is underway after the Justice Department published the proposed rescheduling rule. The public comment period runs through July 22, 2024, and comments can be submitted electronically through their portal. Now is the time to add your comments.

Changes in the NYS Office of Cannabis Management and Cannabis Control Board

A lot has happened regarding the NYS Office of Cannabis Management (OCM) and the Cannabis Control Board (CCB). As May unfolded, we learned of the impending departure of Chris Alexander, Executive Director of the OCM, effective June 7, 2024.

In addition, NYS Governor Kathy Hochul mandated several significant operational changes to the OCM for the short and long-term. The changes came on the heels of the final report that Jeanette Moy, Commissioner of the Office of General Services, issued after her 30-day research mission of the OCM.

The operational changes will have an impact on several aspects of what the OCM manages including:

A new task force to deal with illicit cannabis activity
Licensing procedures
Capital for justice-involved CAURD licensees

New Jersey Cannabis Regulatory Commission

Governor Phil Murphy also instituted some major changes at the the NJ Cannabis Regulatory Commission (CRC) in May. Executive Director Jeff Brown is transitioning to a new position at the NJ Department of Health (DOH) where he will be the new deputy commissioner. His replacement at the CRC will be Christopher Riggs, who previously held the role of deputy executive director and was formerly chief counsel of the CRC.

New Jersey senators approve bill for cannabis regulators to oversee intoxicating hemp-derived products

New Jersey senators approved a bill, NJ S3235, that would extend the oversight of cannabis regulators to include intoxicating hemp products. The proposed legislation would establish regulations for the production and sale of hemp products containing less than 0.5 mg THC per serving, effectively bringing them under the purview of the state’s Cannabis Regulatory Commission (CRC)

Under the new bill, these products would be exclusively sold in licensed dispensaries alongside cannabis. The legislation also seeks to amend the existing NJ Farming Act to impose limits on THC content in hemp products.

“The main intent… is that there is a phenomenal amount of unregulated, unlicensed, untested cannabis products on gas station shelves and convenience store shelves, and they don’t go through any regulated process.” said Scott Rudder of the New Jersey CannaBusiness Association about the legislation. “Teens have access to this, and this bill attempts to capture that to prevent that.”

New Jersey bill would allow state officials to cap medical cannabis prices

NJ Sen. Troy Singleton (D-7) introduced legislation that would grant the CRC the power to implement price caps on medical cannabis products if necessary. Modeled after Pennsylvania’s statute, the bill empowers the commission to intervene when prices are deemed “unreasonable and inconsistent” with actual costs, allowing for price adjustments at six-month intervals.

The price of medical cannabis has long been an area of focus for patient activists in the state. New Jersey’s medical cannabis prices were among the highest in the United States for several years. While they have decreased since adult-use cannabis stores began to open, average prices are still higher than they are in other states.

Chris Goldstein of NORML, who tracks cannabis prices in New Jersey and Pennsylvania dispensaries, said it’s been difficult to watch legal cannabis in other states become more affordable while NJ’s prices remain sky-high.

“Unfortunately, we’ve been sold the same promises for almost 13 years that prices would come down, and there was more competition and more businesses, but the same businesses have been here the whole time, and prices remain remarkably similar,” Goldstein said to Marijuana Moment.

NYC Mayor Eric Adams orders the closure of 75 unlicensed cannabis shops

A joint task force led by the New York City Sheriff’s office led to the closure of 75 unlicensed dispensaries in New York City, totaling more than 3,800 violations and nearly $6 million in civil penalties.

Called “Operation Padlock to Protect,” the joint operation between the NYPD, the sheriff’s office, and the New York City Department of Consumer and Worker Protection (DCWP) conducted 150 inspections across four days in early May. The results of the operations were announced on May 14th.

While not insignificant, the enforcement efforts are a drop in the bucket. According to city agencies, there are an estimated 8,000 unlicensed cannabis shops across the five boroughs.

PA GOP senator says the state is ‘getting close’ to legalization

Senator Dan Laughlin (R-49) asserts that the Keystone State is edging closer to the long-awaited legalization of cannabis. However, Laughlin emphasizes that achieving this milestone requires collaborative efforts from key stakeholders, urging House and Senate leaders to engage in constructive dialogue with the governor to reach a consensus.

Speaking at a rally organized by ResponsiblePA, Laughlin joined forces with Senator Sharif Street (D-3) and other advocates to champion the push for legalization. He highlighted regional dynamics and recent federal rescheduling actions as catalysts for momentum, but noted that the Pennsylvania legislature is still several steps away from more action.

“We’re getting close, [but]…I don’t think we’re going to get this done until the leaders of the House and Senate sit down with the governor of Pennsylvania and work it out,” Laughlin shared.

New York State (NYS) Governor Kathy Hochul and the NYS Legislature vowed to support and fund the closures of the illicit cannabis smoke shops across NYS and New York City (NYC) – and they have included funding in the 2025 NYS budget to do it. The approved budget that was passed this April vows to shut down illegal cannabis operations. An immediate action of this approved budget is that NYC Mayor Eric Adams is getting the immediate authority to use New York City’s enforcement powers to inspect, issue violations, and seize cannabis and padlock stores.

“New Yorkers are fed up with illegal smoke shops and their unlawful business practices, but our administration worked hard to make our voices heard in Albany, and working with Governor Hochul and our state partners, we are proud to say we got it done. New York City will finally be able to use the full force of the law to inspect, enforce, and shut down illegal dispensaries. These measures, combined with our already robust enforcement efforts, will help keep the playing field level and push back against the quality-of-life issues that have resulted from the proliferation of illegal smoke shops. We will continue to work with our partners in Albany to give aspiring entrepreneurs, especially those who have been justice-involved, a chance to succeed.”

NYC Licensing News

This month, the NYS Office of Cannabis Management (NYSOCM) was given the authority by the Cannabis Control Board (CCB) to issue 101 new provisional adult-use licenses to applicants across several segments of the supply chain including: retailers, microbusinesses, cultivators, processors and distributors. The measure was granted during an April 11 meeting of the CCB. This new authority allows the NYSOCM to grant provisional licenses faster but ultimately, the CCB will still have to approve the final license.

The latest news from the NYSOCM for April includes the stats below since March 2021 when the NYS Marijuana Retail and Taxation Act (MRTA) passed:

Approximately 7,000 jobs across NYS have been created

New Jersey Celebrates Cannabis Milestones

This April 2024 marks a 3-year milestone for the New Jersey Cannabis Regulatory Commission, while celebrating a 2-year milestone for recreational cannabis sales. As part of their impressive achievements, in 2023 the NJCRC reached over $800MM in cannabis sales and expects to reach $1B in 2024.

Federal Regulatory News: Descheduling vs. Rescheduling

The buzz about descheduling and rescheduling of cannabis continues and will continue until the DEA makes a decision. Among the latest developments around descheduling is the formation of a legislative group who are pushing to have marijuana removed from Schedule 1. The group sent a letter requesting the descheduling to Attorney General Merrick Garland and to Anne Milgram of the DEA.

Dawne Morris – CEO, Co-Founder, PROTEUS Business Solution, PROTEUS420

This month, we feature a brief interview with Dawne Morris, Co-Founder and CEO of Proteus420, an online enterprise resource planning (ERP) system for the cannabis industry. Dawne is a nationally-recognized cannabis entrepreneur who has been named a Top Women to Watch in Marijuana Venture magazine.

An entrepreneur, a technologist and an advocate, Dawne is a champion of our industry, of women and of the cannabis community. We share our conversation below.

CWCBExpo – Did you ever doubt yourself and how did you overcome that self-doubt?

Dawne – Being a woman in the predominantly male sectors of cannabis and technology has presented numerous moments where self-doubt could have crept in. However, I make it a point not to entertain those doubts. As a professional at the helm of a business, my focus is on running my company efficiently; I don’t have the luxury of time to prove myself to others. Whenever I face uncertainty, I rely on my expertise and knowledge, reminding myself of the path I took to get here. My primary aim is to stay focused and achieve my goals—recognition from others, while appreciated, is secondary.

CWCBExpo – Who was your role model growing up and what impressed you most about that person?

Dawne – My greatest influence has undoubtedly been my father, a skilled cannabis grower who deeply educated me about the plant’s healing potentials. Growing up as a proponent of cannabis, we were cautious to keep our discussions within the home due to potential backlash. Unfortunately, my father passed away six years ago, and expanding our business into the cannabis sector has been a way to honor his legacy. It’s not just about business growth; it’s about continuing his advocacy and educational efforts in a field where I truly thrive. As the world became more accepting of cannabis, my husband and I recognized the opportunity to integrate this personal mission into our professional endeavors.

CWCBExpo – Who is your best friend – OK – who are your “2 besties”?

Dawne – My husband David is undoubtedly my best friend. We’ve experienced so much together, and each morning I wake up eager to face new challenges and adventures alongside him. Additionally, I consider my granddaughters as my other best friends—so technically, I have three best friends. They inspire me daily to be a better person, someone they can admire and learn from. Watching them grow has been one of the greatest lessons of my life, and I cherish every moment with my three best friends!

CWCBExpo – You have been a champion of women, tech, and cannabis as you worked your way up, and you are a true believer in community. What advice do you have for women entrepreneurs in our industry?

“This journey isn’t always easy, but it is rewarding, especially when we lift each other up and champion each other’s successes.”

Dawne – I’ve always been passionate about supporting women in tech and cannabis, industries where we are still underrepresented. My advice to women entrepreneurs in our industry is encapsulated beautifully by Maya Angelou, who said, “Without courage, we cannot practice any other virtue with consistency. We can’t be kind, true, merciful, generous, or honest.” This underscores the importance of courage in our endeavors. It’s crucial to stay true to yourself and remember that you are here for a reason. Your unique insights and contributions are incredibly valuable.

I encourage women to actively connect with and uplift other women in the space. Building a supportive community is not just about networking—it’s about creating a space where we can all thrive. Never let your identity be a barrier. Instead, let it be your strength and your guide as you navigate your path. Remember, by supporting one another, we create a stronger, more inclusive industry. This journey isn’t always easy, but it is rewarding, especially when we lift each other up and champion each other’s successes.
