Legalization and Licensing Milestones

New York State “Medical Home Cultivation”

The New York State Office of Cannabis Management has issued revised Medical Home Cultivation rules that are set to take effect on October 5, 2022.

It is important to know the rules about home grow of medical cannabis. If you are a caregiver or a medical patient make sure you get to know the revised regulations. The NYS Office of Cannabis Management (OCM) released on September 26 a comprehensive “Medical Cannabis Home Cultivation Guide” explaining the new guidelines.

New Jersey Seeking Commentary

There is still time. The New Jersey Cannabis Regulatory Commission is seeking public commentary. They have proposed new rules on numerous aspects of the state’s personal-use cannabis market and want to hear from the public. The comment period expires September 30, 2022.

Federal Legalization: SHIP Act

A federal bill called the Small and Homestead Independent Producers (SHIP) Act, was introduced by Democratic Representative, Jared Huffman of California. If the SHIP Act passes, it would let some cannabis farmers send cannabis orders directly to customers through the mail within California and to other states that have legalized cannabis. But it would only take effect once cannabis is removed from Schedule 1 and when all criminal penalties related to cannabis are removed from federal law.

Related to the SHIP Act being introduced, a group was formed called The National Craft Cannabis Coalition, comprised of groups from Oregon, California, Washington, Vermont, Maine, and Massachusetts. The NCCC supports small-scale growers to be able to thrive and try to compete with the larger multi-state operators. Read about the SHIP Act and the NCCC here in High Times.

As the New York State Office of Cannabis Management progresses its licensing program of legal cannabis businesses, be mindful of the open comment periods which come to an end soon. They are asking for public commentary with noted deadlines as follows:

NYS CANNABIS REGULATIONS OUT FOR PUBLIC COMMENT

  • Proposed Laboratory Testing Regulations – comment period closes August 15, 2022
  • Proposed Packaging, Labeling, Marketing and Advertising Regulations – comment period closes on August 15, 2022
  • Revised Medical Cannabis Regulations – comment period closes September 19, 2022

The New Jersey Cannabis Regulatory Commission has proposed new rules and is also seeking public commentary. They have proposed new rules on numerous aspects of the state’s personal-use cannabis market and want to hear from the public.

Kudos to New Jersey for obliterating the taxes on medical cannabis as of July 1, as part of the 3-phase tax elimination for medical cannabis.

Federal Legalization
It seems that the prospect of federal legalization has signs of hope every now and again, and then the big “but” shows up. Cannabis legalization supporter, Senate Majority Leader Chuck Schumer, introduced legislation to legalize cannabis federally this past July 21.

But – it lacks the necessary bipartisan votes in the Senate to pass. The bill addresses giving states the rights to set cannabis laws in the wake of any federal legalization, including creation of business grant programs to those wanting to enter the industry in communities adversely affected by drug laws. Much more is addressed in the bill “but” much work and more support is needed to get any such bill or parts of it passed.

Recent poll data gathered by the Economist and YouGov showed that by a margin of 2 to 1, Americans are supportive of a Federal legalization mandate legalizing adult use of marijuana.

We also heard from Hip-Hop icon, actor, author and co-founder of the National Cannabis Party, Redman.  Redman’s Keynote, “In Conversation With…” was with Steve Bloom, Publisher and Editor of CelebStoner.com, former Editor of High Times and former Editor-in-Chief of Freedom Leaf. The discussion was energetic and riveting as Steve and Redman discussed Redman’s climb in music, pop-culture and activism. We learned about Redman’s most recent journey as co-founder of the National Cannabis Party.

The Keynote Conversations continued with Nick Kovacevich, CEO of Greenlane Holdings talking with Tim Seymour, Co-Anchor of CNBC’s Fast Money. The audience heard about Nick’s pioneering journey as co-founder and chair of KushCo Holdings and his rise to Greenlane Holdings, which merged with KushCo Holdings in 2021. Nick’s leadership has led to the success and growth of Greenlane Holdings.

A session called “Licensing & the Illicit Market” discussed how legalization will affect illicit markets. The session was moderated by Mona Zhang, States Cannabis Policy Reporter for Politico. A special ground-breaking city-state panel, “Building an Equitable Cannabis Industry Across City and State,” was featured as part of the city-state collaboration to support cannabis licensing across the city and state. Panelists included commissioners from the Mayor’s Office on Equity, the Economic Development Corporation, the Small Business Services, and the NYS Office of Cannabis Management (OCM).

Social Equity in Cannabis 
The session, “Roundtable: Social Equity – Progress & Needed Change,” featured industry business owners, executives and professionals who have been working toward an equitable and fair cannabis industry for people of color, women, and all minorities. While progress has been made, much more needs to be done and all eyes are on NYS to implement a cannabis program that is the model for the entire nation regarding social equity provisions.

Master Session Workshop: Dispensaries

With the wave of legalization across the USA for medical cannabis and adult-use cannabis, owning a dispensary has become a desirable goal for many as it can be quite lucrative. This workshop went through the entire real-life experience of owning a dispensary. Attendees heard from east and west coast dispensary owners, retailers, and designers about getting a license and owning, maintaining, expanding, and selling a dispensary.

We were proud to provide a platform for several roundtables and sessions that highlighted living a healthy life with cannabis, as well as making good and responsible decisions when consuming cannabis. Roundtables on sustainability, health and wellness and cultivation were featured. The panelists included business owners, cultivators, industry experts, and technologists.

The sustainability session, Roundtable: Eco-Conscious Cannabis, discussed the important questions such as: How was your cannabis grown? Did it get produced, grown, harvested, extracted, packaged, stored and sold with sustainability and eco-safety in mind? Do you care and do you know about the safety standards and the supply chain of how that cannabis you bought was grown and how it was handled all the way through to sale for consumption?

Legalization and Licensing Milestones

New York City

New York City Mayor Eric Adams has proposed an investment of  $4.8 Million in the 2023 fiscal year budget to help support the growth of the cannabis industry in New York City. The funding will create outreach agencies and programs that focus on those communities impacted by the war on drugs. It also supports new businesses seeking licenses to operate dispensaries and other cannabis businesses in New York City. It is a positive approach and the Mayor has committed to work with state and local leaders to make New York the most equitable cannabis industry and a model for the entire nation.

In our March Newsletter we mentioned that Governor Phil Murphy updated his state budget to reflect the anticipated revenue that legal marijuana will generate for his state. Well, that revenue started to be generated April 21 when New Jersey opened 13 approved dispensaries to sell up to one ounce of marijuana to adults 21 years and older. Indeed there was traffic along the routes where the dispensaries were located, and long lines to get in, and at some of the dispensaries, sales were done by appointment only. Adult sales started and it was an historic day indeed.

Kudos to the recent Pennsylvania Senate who gave a bi-partisan approved vote to allow legal cannabis businesses access to better banking and insurance services. The bill authorizes but does not require banks and insurers to provide services to cannabis businesses. Banks and insurers are protected against penalties for providing such services.

Federal Legalization

In our March Newsletter we highlighted how the lack of Federal legalization is an obstacle for legitimate businesses to be successful. Federal illegalization constantly and negatively impacts cannabis business owners from getting service from financial institutions in states where cannabis is legal. Representative Ed Perlmutter (D-CO) has urged his colleagues to at least pass the SAFE Banking Act as a first step to help cannabis businesses in the absence of Federal Legalization. Parkinson’s Disease

Alternative treatments and medications that the cannabis plant has to offer are vigorously sought after by those suffering from many medical conditions. This month we highlight Parkinson’s Disease. Parkinson’s is a neurodegenerative disorder that affects the dopamine-producing (“dopaminergic”) neurons in a specific area of the brain called substantia nigra. The Parkinson’s Foundation asserts that more research is needed to determine how cannabis should be administered and how the long-term use of cannabis might affect Parkinson’s patients manage their tremors, balance issues, limb rigidity and slow movements that result from Parkinson’s Disease.

Substantial progress continues on the East Coast regarding Adult Use. On March 15, New York State (NYS) Governor Kathy Hochul announced the opening of the Application Portal for hemp farmers to obtain an Adult Use Cannabis Conditional Cultivator License to grow marijuana.

In addition, the portal will allow applicants with prior convictions to apply for a retail license under the “Seeding Opportunity Initiative.” The groundbreaking approach to inclusion and social equity gives those individuals and communities who have been negatively and economically impacted to get priority with the first issued licenses.

New York State OCM and CCB issued regulations for the Cannabinoid Hemp Program, comment period now in effect

Chris Alexander from the Office of Cannabis Management (OCM) and members of his staff attended the CWCBExpo. The Office of Cannabis Management continues to trailblaze for New York State, implementing the Marijuana Regulation & Taxation Act (MRTA).

In New York State, the Cannabis Control Board has made great progress

On October 21, the Cannabis Control Board advanced regulations for public comment that will allow for the home cultivation of medical cannabis. The regulations follow the requirements of the Marijuana Regulation and Taxation Act, allowing for up to three mature plants and three immature plants per person and a cap of six mature and six immature plants within any private residence. The regulations will now be subject to a 60-day public comment period.

Decriminalize Drugs or Legalize?

Medical marijuana is now legal in more than half of the country. The cities of Denver, Seattle, Washington and Oakland, California, have also decriminalized psilocybin (the psychedelic element in “magic mushrooms”). Oregon went one step further, decriminalizing all drugs in small quantities, including heroin, cocaine and methamphetamine.

Marijuana Arrests in New York City Drop 95% After Legalization (CannabisNet)

“During the second quarter of 2021, New York City’s police department recorded only eight cannabis-related arrests. Six of which were for illegal possession of cannabis and the other two for illegal sales.

“The current legislation states that adults over 21 now have the right to possess adult-use cannabis of not more than three ounces. It also permits the sale of cannabis, however, this has been paused due to the delay in setting up the state’s cannabis regulatory council.”

He told WPRI-TV that while there are still outstanding issues to be resolved, he believes legalization will be taken up before the end of the year.

“We can’t reverse the harm of the war on drugs, but we can start to repair it by passing automatic expungement and waiving all related fines, fees and court debt,” Rep. Karen Alzate (D), chair of the Rhode Island Legislative Black and Latino Caucus, said earlier this month. “This bold legalization plan offers us the chance to turn a new leaf for the Ocean State, and it’s time we take it.”
