Legalization and Licensing Milestones

New York State “Medical Home Cultivation”

The New York State Office of Cannabis Management has issued revised Medical Home Cultivation rules that are set to take effect on October 5, 2022.

It is important to know the rules about home grow of medical cannabis. If you are a caregiver or a medical patient make sure you get to know the revised regulations. The NYS Office of Cannabis Management (OCM) released on September 26 a comprehensive “Medical Cannabis Home Cultivation Guide” explaining the new guidelines.

New Jersey Seeking Commentary

There is still time. The New Jersey Cannabis Regulatory Commission is seeking public commentary. They have proposed new rules on numerous aspects of the state’s personal-use cannabis market and want to hear from the public. The comment period expires September 30, 2022.

Federal Legalization: SHIP Act

A federal bill called the Small and Homestead Independent Producers (SHIP) Act, was introduced by Democratic Representative, Jared Huffman of California. If the SHIP Act passes, it would let some cannabis farmers send cannabis orders directly to customers through the mail within California and to other states that have legalized cannabis. But it would only take effect once cannabis is removed from Schedule 1 and when all criminal penalties related to cannabis are removed from federal law.

Related to the SHIP Act being introduced, a group was formed called The National Craft Cannabis Coalition, comprised of groups from Oregon, California, Washington, Vermont, Maine, and Massachusetts. The NCCC supports small-scale growers to be able to thrive and try to compete with the larger multi-state operators. Read about the SHIP Act and the NCCC here in High Times.

New York
As the New York State Office of Cannabis Management progresses its licensing program of legal cannabis businesses, be mindful of the open comment periods which come to an end soon. They are asking for public commentary with noted deadlines as follows:

NYS CANNABIS REGULATIONS OUT FOR PUBLIC COMMENT

Proposed Laboratory Testing Regulations – comment period closes August 15, 2022
Proposed Packaging, Labeling, Marketing and Advertising Regulations – comment period closes on August 15, 2022
Revised Medical Cannabis Regulations – comment period closes September 19, 2022

New Jersey
The New Jersey Cannabis Regulatory Commission has proposed new rules and is also seeking public commentary. They have proposed new rules on numerous aspects of the state’s personal-use cannabis market and want to hear from the public.

The comment period expires September 30, 2022.

Kudos to New Jersey for obliterating the taxes on medical cannabis as of July 1, as part of the 3-phase tax elimination for medical cannabis.

Federal Legalization
It seems that the prospect of federal legalization has signs of hope every now and again, and then the big “but” shows up. Cannabis legalization supporter, Senate Majority Leader Chuck Schumer, introduced legislation to legalize cannabis federally this past July 21.

But – it lacks the necessary bipartisan votes in the Senate to pass. The bill addresses giving states the rights to set cannabis laws in the wake of any federal legalization, including creation of business grant programs to those wanting to enter the industry in communities adversely affected by drug laws. Much more is addressed in the bill “but” much work and more support is needed to get any such bill or parts of it passed.

Recent poll data gathered by the Economist and YouGov showed that by a margin of 2 to 1, Americans are supportive of a Federal legalization mandate legalizing adult use of marijuana.

Show Floor Highlights

Exhibitors, sponsors, attendees and speakers networked on the show floor and at after-hour events, keeping the business discussions going and flowing.

Education Pavilion

Continuing the commitment to support education, the show floor featured an environment for those colleges that have cannabis curricula to exhibit their offerings. This show floor feature has helped to further tear down the stigma of cannabis and help highlight the most progressive learning opportunities. Many of these colleges are seeking to attract and partner with exhibiting companies and business owners who were at CWCBExpo to educate their workforces and communities.

Women Grow Pavilion

In keeping with helping to build the marketplace and industry, the Women Grow Pavilion featured 30 entrepreneurs who are leading female-owned cannabis-related businesses who exhibited their new products and innovations.

Proud Mary Lounge

We proudly celebrated Pride Month with the Proud Mary Lounge. Co-founded by Brie Brewer, Proud Mary advocates for LGBTQ+ inclusion in the cannabis industry. Proud Mary exhibited for the first time ever in a cannabis trade show and created the Proud Mary Lounge where everyone was welcome to relax and network in an inclusionary environment.

Hosted by Dasheeda Dawson and Ice Dawson, the award winning podcast went live from the show floor and interviewed our exhibitors, attendees and speakers.

Conference Highlights

Headliners, Keynotes, and Roundtables

The conference was kicked off with an informative industry update, “Trends and Opportunities in Marijuana and Hemp,” presented by Amanda Reiman, Vice President Policy Research, New Frontier Data. It was a great start to the first-day’s theme which was focused on investment.

The two investment-focused roundtables were presented with trailblazers and pioneers in the industry. One was, “Roundtable: Investors – Weed Meets Wall Street.”

Business leaders included: Terry Booth, CEO, Audacious/Australis Capital (AUSA); Steve Abraham, Head of Corporate Development and Investor Relations, The Blinc Group; Jay Czarkowski, Founding Partner, Canna Advisors; Chip Daniels, Founder, State Stox Group; moderated by Carl Cameron, Journalist.

The other roundtable was, “Beverages – Where is the Greenest Grass Growing and Flowing?” with industry business leaders: Tracy Mason, Co-Founder and CEO, House of Saka; Ron Shapira, CFA, Founder, Mosaic Advisory Partners; Ken VandeVrede, CEO Hillview Med; moderated by Christopher Smith, American Cannabis Report.

The attendees were captivated with the discussion about the future that beverages and cannabis have and how it can flourish.

CWCBExpo New York continued our Keynote, “In Conversation With…” series with Weedmaps CEO, Chris Beals, who spoke with Mona Zhang, States Cannabis Policy Reporter, Politico. They spoke to a packed audience about the history of Weedmaps and its success across the nation in promoting safe consumption and inclusion, and what’s next.

We also heard from Hip-Hop icon, actor, author and co-founder of the National Cannabis Party, Redman. Redman’s Keynote, “In Conversation With…” was with Steve Bloom, Publisher and Editor of CelebStoner.com, former Editor of High Times and former Editor-in-Chief of Freedom Leaf. The discussion was energetic and riveting as Steve and Redman discussed Redman’s climb in music, pop-culture and activism. We learned about Redman’s most recent journey as co-founder of the National Cannabis Party.

The Keynote Conversations continued with Nick Kovacevich, CEO of Greenlane Holdings talking with Tim Seymour, Co-Anchor of CNBC’s Fast Money. The audience heard about Nick’s pioneering journey as co-founder and chair of KushCo Holdings and his rise to Greenlane Holdings, which merged with KushCo Holdings in 2021. Nick’s leadership has led to the success and growth of Greenlane Holdings.

An Historic Year for New York

In this historic year of legalized cannabis in New York, Mayor Eric Adams came to CWCBExpo and brought greetings and special remarks to attendees.

The audience heard first-hand about Mayor Adams’ support of the emerging cannabis and hemp industries.

Update on Licensing from Tremaine Wright, Chair of the New York Cannabis Control Board
Gia Moron, President of Women Grow and Founder of GVM Communications, spoke with Tremaine Wright, Chair of the NYS Cannabis Control Board. The audience received an update on NYS cannabis licensing. An enthusiastic Q/A period was had. Chair Wright walked the floor afterward and visited exhibitors.

Licensing and the Illicit Market

A session called “Licensing & the Illicit Market” discussed how legalization will affect illicit markets. The session was moderated by Mona Zhang, States Cannabis Policy Reporter for Politico. Panelists included Chris Beals, CEO, Weedmaps; Dasheeda Dawson, Chair, Cannabis Regulators of Color Coalition; and Calvin Frye, Cannabis Pioneer and Entrepreneur, and Founder of Cloneville.

City and State Collaboration

A special ground-breaking city-state panel, “Building an Equitable Cannabis Industry Across City and State,” was featured as part of the city-state collaboration to support cannabis licensing across the city and state. Panelists included commissioners from the Mayor’s Office on Equity, the Economic Development Corporation, the Small Business Services, and the NYS Office of Cannabis Management (OCM).

The speakers were: Andrew Kimball, President, Economic Development Corp; Commissioner Kevin Kim, Small Business Services; Commissioner Sideya Sherman, Mayor’s Office of Equity; Chris Alexander, Executive Director, Office of Cannabis Management; the moderator was Carlyn S. Buckler, Associate Professor Cornell University, School of Practice School of Integrative Plant Science.

Social Equity in Cannabis
The session, “Roundtable: Social Equity – Progress & Needed Change,” featured industry business owners, executives and professionals who have been working toward an equitable and fair cannabis industry for people of color, women, and all minorities. While progress has been made, much more needs to be done and all eyes are on NYS to implement a cannabis program that is the model for the entire nation regarding social equity provisions.

The audience heard from Jerel Registre, Fund Managing Director, Curio Wellness; Faye Coleman, Founder and CEO, Pure Genesis; Leo Bridgewater, Co-founder, Collective 60 New Jersey; Carlyn S. Buckler, Associate Professor Cornell University, School of Practice School of Integrative Plant Science, Chair of the Cornell College of Agriculture and Life Sciences Diversity and Inclusion Committee; moderated by Tanya Osborne, Founder CannaDiva, LLC, Director of Community Engagement and Digital Production for Women Grow.

Master Session Workshop: Dispensaries

With the wave of legalization across the USA for medical cannabis and adult-use cannabis, owning a dispensary has become a desirable goal for many as it can be quite lucrative. This workshop went through the entire real-life experience of owning a dispensary. Attendees heard from east and west coast dispensary owners, retailers, and designers about getting a license and owning, maintaining, expanding, and selling a dispensary.

The workshop was moderated by Calvin Frye, Cannabis Pioneer and Entrepreneur, Founder Cloneville, while the speakers included: Faye Coleman, Founder/CEO, Pure Genesis; Nichelle Santos, Founder/CEO, Canna Coverage; Angela Wright, Founder/CEO, National Botanical Company; Neil Kaufman, Managing Member, Kaufman-McGowan, PLLC; Mitzi Keating, Citrin Cooperman; Harry Carpenter, Citrin Cooperman; Colleen Higgins, RPh, Pharmacist; Bob Kassoff, VP, Sales and Marketing, Wilson Safe Company; Norman Chevlin, Founder and CEO, Plant Your Financial Seed; Dario Boyce, Project Manager, Anderson Porter Design; Greg Miller, President of Retail, Curio Wellness.

Cannabis and Lifestyle

We were proud to provide a platform for several roundtables and sessions that highlighted living a healthy life with cannabis, as well as making good and responsible decisions when consuming cannabis. Roundtables on sustainability, health and wellness and cultivation were featured. The panelists included business owners, cultivators, industry experts, and technologists.

The sustainability session, Roundtable: Eco-Conscious Cannabis, discussed the important questions such as: How was your cannabis grown? Did it get produced, grown, harvested, extracted, packaged, stored and sold with sustainability and eco-safety in mind? Do you care and do you know about the safety standards and the supply chain of how that cannabis you bought was grown and how it was handled all the way through to sale for consumption?

Attendees heard from knowledgeable panelists about the importance of maintaining a sustainable environment: Matthew Broxterman, Director of Sales, Boulder Creek Technologies; Jason Thomas, Founding Partner, Precision Quality Compliance; Kyle Georges, VP Sales and Business Development, Maratek Environmental; George Stantchev, CEO, COMERG; moderated by Carl Cameron.

A Health & Wellness session, Roundtable: Living a Healthy Life with Cannabis, heard from business owners and supporters of a healthy lifestyle while incorporating cannabis. The discussions focused on regimens of infused products, edibles, food preparation, CBD oils, vaping and exercise.

Panelists included Jenny Argie, Founder and Owner, Jenny’s Home Baked Goods; Arnaud Dumas de Rauly, Co-Founder/CEO The Blinc Group; Rob Mejia, Adjunct Professor, Stockton University, Cannabis Studies Department; moderated by Christina DiGiovanni, Founder and CEO, The Emerald.

The session, Roundtable: Cultivation, highlighted important topics that must be considered in cultivation, such as artificial intelligence, genetics, quality control, and effective and intelligent grow methods.

Speakers included, Ian Seiferling, CEO, Adaviv; Calvin Frye, Founder, Cloneville; moderated by Gretchen Gailey, Chief Strategist, CWCBExpo.

Networking Events

Attendees, speakers, and exhibitors took part in networking events that allowed the business-building to continue after the show floor closed. CWCBExpo’s Cannabis Week, which ran from May 31 – June 5, allowed the New York business community to take part in numerous special events that sparked mind-share, education, fun, and business opportunities.

Congratulations to NORML and Curved Papers for another successful NORML FORML. Advocacy is an important part of our industry and this is always a wonderful event to kick-off CWCBExpo.

Legalization and Licensing Milestones

New York City

New York City Mayor Eric Adams has proposed an investment of $4.8 Million in the 2023 fiscal year budget to help support the growth of the cannabis industry in New York City. The funding will create outreach agencies and programs that focus on those communities impacted by the war on drugs. It also supports new businesses seeking licenses to operate dispensaries and other cannabis businesses in New York City. It is a positive approach and the Mayor has committed to work with state and local leaders to make New York the most equitable cannabis industry and a model for the entire nation.

New Jersey

In our March Newsletter we mentioned that Governor Phil Murphy updated his state budget to reflect the anticipated revenue that legal marijuana will generate for his state. Well, that revenue started to be generated April 21 when New Jersey opened 13 approved dispensaries to sell up to one ounce of marijuana to adults 21 years and older. Indeed there was traffic along the routes where the dispensaries were located, and long lines to get in, and at some of the dispensaries, sales were done by appointment only. Adult sales started and it was an historic day indeed.

Pennsylvania

Kudos to the recent Pennsylvania Senate who gave a bi-partisan approved vote to allow legal cannabis businesses access to better banking and insurance services. The bill authorizes but does not require banks and insurers to provide services to cannabis businesses. Banks and insurers are protected against penalties for providing such services.

Federal Legalization

In our March Newsletter we highlighted how the lack of Federal legalization is an obstacle for legitimate businesses to be successful. Federal illegalization constantly and negatively impacts cannabis business owners from getting service from financial institutions in states where cannabis is legal. Representative Ed Perlmutter (D-CO) has urged his colleagues to at least pass the SAFE Banking Act as a first step to help cannabis businesses in the absence of Federal Legalization. Health and Cannabis

Parkinson’s Disease

Alternative treatments and medications that the cannabis plant has to offer are vigorously sought after by those suffering from many medical conditions. This month we highlight Parkinson’s Disease. Parkinson’s is a neurodegenerative disorder that affects the dopamine-producing (“dopaminergic”) neurons in a specific area of the brain called substantia nigra. The Parkinson’s Foundation asserts that more research is needed to determine how cannabis should be administered and how the long-term use of cannabis might affect Parkinson’s patients manage their tremors, balance issues, limb rigidity and slow movements that result from Parkinson’s Disease.

New York

Substantial progress continues on the East Coast regarding Adult Use. On March 15, New York State (NYS) Governor Kathy Hochul announced the opening of the Application Portal for hemp farmers to obtain an Adult Use Cannabis Conditional Cultivator License to grow marijuana.

In addition, the portal will allow applicants with prior convictions to apply for a retail license under the “Seeding Opportunity Initiative.” The groundbreaking approach to inclusion and social equity gives those individuals and communities who have been negatively and economically impacted to get priority with the first issued licenses.

New Jersey

Home to Chesapeake Bay, the beautiful state of Maryland is looking to advance recreational marijuana with the legislative bill advancing in the State House which seeks to amend their state constitution by a vote in November. We will keep watching for developments.

Senate Majority Leader, Chuck Schumer plans to push forward the Cannabis Administration and Opportunity Act (CAOA) this April. Drug Convictions, Social Justice, Social Equity

Report on drug convictions in New York that were not justified is revealed in a detailed report. Widespread drug tests that were flawed but yet, were used to convict and incarcerate individuals. Expunging pot convictions is proving to be a long and arduous process in many state and the delays and bureaucracy continue to impact the convicted individuals, their families and communities. The timeline for clearance and many other challenges persist for those who are still waiting to be cleared in California. We have had numerous requests for the full session presentation that Tremaine Wright, Chair of the New York Cannabis Control Board, gave at our CWCBExpo Conference at the Jacob Javits Center in New York City.

It is quite timely to share Chair Wright’s dynamic and informational address since New York State is now a legal Recreational Use state since passing the Marijuana Regulation & Taxation Act (MRTA) in 2021.

In our December newsletter we shared a brief interview that Christopher “CJ” Wallace gave immediately following his Keynote Conversation with Dan Harris. The New York Office of Cannabis Management (OCM) has opened the Enhanced Application Portal for Cannabinoid Hemp Program licensing.

The New Jersey Cannabis Regulatory Commission (NJCRC) started to accept cannabis recreation license applications on December 15, 2021. Pharmaceutical News

Pfizer has announced their acquisition of Arena Pharmaceuticals, based in San Diego, Ca. The purchase price was set at $6.7B. Arena Pharmaceuticals is researching and developing cannabinoid-based therapeutics and has developed an oral medication called Olorinab. Read about it in Hemp Today.

CWCBExpo New York 2021 celebrated “Back-to-Business!”

Tremaine Wright, Chair of the New York State Cannabis Control Board (CCB), gave her first public Keynote at CWCBExpo. (The full presentation will be coming soon to the CWCBExpo Insider Archive.)

Christopher “CJ” Wallace, Founder Think Big and Frank White, delivered a Keynote that described his entrepreneurial journey within the cannabis industry and how he intends to work diligently to advocate for inclusion of people of color and other minorities to be business owners and benefit from the industry.

After his Keynote, the audience wanted more.

New York State OCM and CCB issued regulations for the Cannabinoid Hemp Program, comment period now in effect

Chris Alexander from the Office of Cannabis Management (OCM) and members of his staff attended the CWCBExpo. The Office of Cannabis Management continues to trailblaze for New York State, implementing the Marijuana Regulation & Taxation Act (MRTA).

New Jersey application process to begin December 15

The New Jersey Cannabis Regulatory Commission on Tuesday announced it would open the application process to marijuana growers, processors and testing labs on Dec. 15, and It will open applications for dispensaries on March 15, 2022.

In New York State, the Cannabis Control Board has made great progress

On October 21, the Cannabis Control Board advanced regulations for public comment that will allow for the home cultivation of medical cannabis. The regulations follow the requirements of the Marijuana Regulation and Taxation Act, allowing for up to three mature plants and three immature plants per person and a cap of six mature and six immature plants within any private residence. The regulations will now be subject to a 60-day public comment period.

NYS Dispensaries Sell First Whole Flowers

On October 26, several of New York’s medical cannabis dispensaries began selling smokable “whole flower,” the bud of the cannabis plant, for the first time since the Compassionate Care Act passed in 2014 to legalize marijuana for certain medical uses.

Can Fake Pot Plants Change Minds About Marijuana?

Pot Plant, an on-line store that opened last fall, sells artificial weed plants that are meant to be displayed in homes and businesses. But they aren’t just for show, the company’s founders say. They hope these plantlike objects will also help challenge negative attitudes toward marijuana.

Decriminalize Drugs or Legalize?

Medical marijuana is now legal in more than half of the country. The cities of Denver, Seattle, Washington and Oakland, California, have also decriminalized psilocybin (the psychedelic element in “magic mushrooms”). Oregon went one step further, decriminalizing all drugs in small quantities, including heroin, cocaine and methamphetamine.

Attitudes toward drugs have changed considerably over the years. But the question of whether all drugs should be legalized continues to be contentious. How much have attitudes toward illegal drugs changed? And why?

Marijuana Arrests in New York City Drop 95% After Legalization (CannabisNet)

“During the second quarter of 2021, New York City’s police department recorded only eight cannabis-related arrests. Six of which were for illegal possession of cannabis and the other two for illegal sales.

“The current legislation states that adults over 21 now have the right to possess adult-use cannabis of not more than three ounces. It also permits the sale of cannabis, however, this has been paused due to the delay in setting up the state’s cannabis regulatory council.”

Rhode Island Lawmakers Are ‘Very Close’ On Marijuana Legalization Deal Ahead Of Possible Special Session, Top Senator Says (MarijuanaMoment)

“Senate President Dominick Ruggerio (D) was asked for a status update on negotiations that have been taking place on the reform proposal since lawmakers adjourned for the session. He told WPRI-TV that while there are still outstanding issues to be resolved, he believes legalization will be taken up before the end of the year.

“We can’t reverse the harm of the war on drugs, but we can start to repair it by passing automatic expungement and waiving all related fines, fees and court debt,” Rep. Karen Alzate (D), chair of the Rhode Island Legislative Black and Latino Caucus, said earlier this month. “This bold legalization plan offers us the chance to turn a new leaf for the Ocean State, and it’s time we take it.”
